5-0 out of 5 stars Great Book
Wonderful book. Was the perfect substitute for reading my casebook, outlining, or even going to class.

3-0 out of 5 stars Is this Environmental "Law" or Environmental "Science"?
As most law students have experienced, the "Examples and Explanations" series is usually a step above the other study aids, with its focus on real-world, exam-style questions and answers. "Examples" usually gives you the black letter law, some basic questions to make sure you understand the nuances, and then helps you connect the dots in your course with more detailed mini-essay questions. Sadly, the "Environmental Law" installment of this series is woefully disappointing.

Essentially, this STUDY AID reads more like a textbook for an Environmental Science course, and a particularly radical, biased textbook at that! Now, I'm not anti-environment (I wouldn't be taking Environmental Law if I was), but at times it seems like fully half this text is filled with extraneous commentary on the impending collapse of global civilization. I have no idea whether this is true or not, but this does NOT help one answer questions on the Clean Water Act, Clean Air Act, or RCRA. Hundreds of pages that could have been devoted to applying federal statutes is wasted in this manner (and not just by way of background, either). One wonders how much of a smaller carbon footprint the author would have had if he had kept to his assigned subject!

With all its faults, I can't recommend this particular installment in "E&E" series... just sticking with your casebook and statutory supplement is almost certainly a better bet. If you like to read about environmental science and ecology in your spare time, however, here's your book. ... Read more

Editorial Review

Product Description
In this book David Driesen shows in detail how the concept of economic dynamics can reshape thinking about environmental law and policy. He argues that environmental policymaking in the United States has been poorly served by the dominant, static view of the relationship between environmental regulation and the economy, technology, and business. Basing public policy on the concept of economic efficiency, he claims, warps our sense of what is necessary and achievable in environmental lawmaking.According to Driesen, environmentally beneficial technological innovation would be a more effective public policy goal than economic efficiency because it could better keep pace with private-sector innovations that create new forms of pollution and resource destruction. His arguments provide a corrective to the free-market and cost-benefit analysis approaches common to most proposals for regulatory reform. Those who believe that environmental law should focus on economic efficiency assume that efficiency and innovation coincide. But static efficiency may detract from, rather than stimulate, creativity in the real world. Cost-benefit analysis may discourage innovation by adding delay and uncertainty to government decisions. Economic incentives such as emissions trading may facilitate better use of existing techniques rather than bring about fundamental changes in technology. Driesen suggests ways that the regulatory system could better foster environmentally beneficial technological innovations. Using the theory of economic dynamics, he discusses privatizing environmental law, reforming administrative and international legal processes, and improving regulation design. He also explains the significance of economic dynamics for legal theory in general. ... Read more

Product Description
While governments assert that Canada is a world leader in sustainability, Unnatural Law provides extensive evidence to refute this claim. A comprehensive assessment of the strengths and weaknesses of Canadian environmental law, the book provides a balanced, critical examination of Canada’s record, focusing on laws and policies intended to protect water, air, land, and biodiversity.

Three decades of environmental laws have produced progress in a number of important areas, such as ozone depletion, protected areas, and some kinds of air and water pollution. However, Canada’s overall record remains poor. In this vital and timely study, David Boyd explores the reasons why some laws and policies foster progress while others fail. He ultimately concludes that the root cause of environmental degradation in industrialized nations is excessive consumption of resources. Unnatural Law outlines the innovative changes in laws and policies that Canada must implement in order to respond to the ecological imperative of living within the Earth’s limits.

The struggle for a sustainable future is one of the most daunting challenges facing humanity in the 21st century. Everyone - academics, lawyers, students, policy-makers, and concerned citizens - interested in the health of the Canadian and global environments will find Unnatural Law an invaluable source of information and insight. ... Product Description
Contemporary environmental regulation is facing significant challenges. These challenges are varied, and include the search for economic efficiency, popular mistrust of experts and frequent observation of poor practical results. At EU level, criticisms of regulatory activity are compounded by the significant questions that surround the legitimacy of certain EU institutions and processes. This book examines a range of substantive EU environmental law and policy, and considers far-reaching endeavours to improve environmental regulation. One striking feature of contemporary EU environmental law is its wholehearted preoccupation with the structure of decision-making. This development, and some of the serious tensions that arise in the legal conditions for decision-making, form a major theme of this book. ... Read more

Product Description

Today's most pressing environmental problems are planetary in scope, confounding the political will of any one nation. How can we solve them?

Global Environmental Governance offers the essential information, theory, and practical insight needed to tackle this critical challenge. It examines ten major environmental threats-climate disruption, biodiversity loss, acid rain, ozone depletion, deforestation, desertification, freshwater degradation and shortages, marine fisheries decline, toxic pollutants, and excess nitrogen-and explores how they can be addressed through treaties, governance regimes, and new forms of international cooperation.

Written by Gus Speth, one of the architects of the international environmental movement, and accomplished political scientist Peter M. Haas, Global Environmental Governance tells the story of how the community of nations, nongovernmental organizations, scientists, and multinational corporations have in recent decades created an unprecedented set of laws and institutions intended to help solve large-scale environmental problems. The book critically examines the serious shortcomings of current efforts and the underlying reasons why disturbing trends persist. It presents key concepts in international law and regime formation in simple, accessible language, and describes the current institutional landscape as well as lessons learned and new directions needed in international governance. Global Environmental Governance is a concise guide, with lists of key terms, study questions, and other features designed to help readers think about and understand the concepts discussed.

Product Description

Although many developing countries have environmental statutes, regulations, and resolutions on the books, these laws are rarely enforced and often ignored.Making Law Matter presents the first book-length treatment of an innovative prosecutorial institution, the Brazilian Ministrio Publico, which refashioned itself in the 1980s into a powerful defender of citizen rights in environmental protection, as well as in other areas of public interest such as disability rights, consumer protection, and anticorruption.

In Brazil, the offices of prosecutors and courts have become an important forum for resolving environmental conflicts, making environmental law more effective than in the past.Court involvement communicates the end of impunity for violators. It increases the accountability of governmental agencies and provides legal access for citizen complaints. In short, it enhances environmental rule of law.As developing countries continue to seek to reform their legal systems to strengthen democracy and the rule of law, the Brazilian Ministrio Publico must be recognized as a very promising model.

5-0 out of 5 stars Well organized and informative
Unlike many of the "nutshell" series, which can reduce a reading of the law below the level of comprehension or usefulness, this book really works. It is well organized, informative and very readable. If you are just starting to explore an issue in international environmental law, this is a good book to launch your query. Even better, this book gives you both a solid outline of the structure and substance of the law, and gives you a good introduction to several of the major issues currently in process. Like my dictionary, I'll keep this one handy.

Professor Gurswamy's Nutshell on International Environmental Law provides an excellent introduction to international environmental issues, without getting overly bogged down in either technobabble or legalisticboilerplate. It serves as an excellent introduction to the issues, and isclear to any layman.

A must read for anyone interested in the environment and global politics. This book, though designed for lawyers, would be useful for classrooms from high school on up - and for laypeople interested in knowing more aboutinternational environmental politics, a subject of growing importance. ... Product Description
This book is the first comprehensive assessment of the legal duties of states with regard to human induced climate change damage. By discussing the current state of climate science in the context of binding international law, it convincingly argues that compensation for such damage could indeed be recoverable. The author analyses legal duties requiring states to prevent climate change damage, and discusses to what extent a breach of these duties will give rise to state responsibility (international liability). The analysis includes the UN Framework Convention on Climate Change and the Kyoto Protocol, but also various nature/ biodiversity protection and law of the sea instruments, as well as the no-harm-rule as a key provision of customary international law. The challenge in applying the different aspects of the law on state responsibility, including causation and standard of proof, are discussed in three case studies, and the questions raised by multiple polluters explored in depth. Against this background, the author advocates an internationally negotiated solution to the issue of climate change damage. ... Read more
