Hazardous Waste and Materials and Resource Conservation and Recovery Act
The Resource Conservation and Recovery Act (RCRA) gave EPA the authority to control hazardous waste from the "cradle-to-grave." This includes the generation, transportation, treatment, storage, and disposal of hazardous waste. RCRA also set forth a framework for the management of non-hazardous wastes. The 1986 amendments to RCRA enabled EPA to address environmental problems that could result from underground tanks storing petroleum and other hazardous substances. RCRA focuses only on active and future facilities and does not address abandoned or historical sites (see CERCLA See: Storage Tanks RCRA Resource Conservation and Recovery Act- RCRAimp1.doc

Case No. 2 Topic:Environment: Hazardous Waste Local Government: Tottori Prefecture Document Title: Vice Governorfs Meeting Minutes Date of Request: unknown Date of Disclosure: unknown Degree of Disclosure: Partial Disclosure (exceptions for personal information, deliberative information) Case Summary: In 1988 it became known that waste soil generated from the mining of uranium from the Ningyo Pass between Tottori and Okayama prefectures was being dumped in the mountain forests of Katamo in Higashisato village in Tottori prefecture. In 1990, upon demands by area residents to remove the waste soil, the mine operator (the former Donen) entered into an agreement with the local council promising to remove the soil from the Katamo area and carry it back to the mining operations area at Ningyo Pass in Okayama prefecture. However, that plan was frustrated because of opposition from the governor of Okayama prefecture, and the waste soil from the uranium mine stayed where it had been dumped. In 1996, with the lease contract for the waste soil dumpsite at an end, and the mining operation continuing to illegally occupy the land, Tottori prefecture moved to try to solve the problem. In 1997 there was consideration given to storing the soil on prefectural land in Sancho village, but this was frustrated when the village would not give its permission. After that, the prefecture proposed storing the waste soil at various locations in Higashisato village, and the village council voted to accept this resolution. A village association of fruit growers entered its name as able to provide a storage place for the soil, but there was strong resistance from local residents, and even now there is still no resolution in sight.

ADVISORY FORUM ON HAZARDOUS WASTE SET UP
The membership of a new forum to advise on the reduction and safe management of hazardous waste was announced today by Environment Secretary Margaret Beckett The Forum will have a strategic role of considering the demands on industry of existing and forthcoming legislation, to consider targets for hazardous waste reduction and recovery, and to provide a means for bringing all relevant sectors together to work towards the goals of hazardous waste reduction and managing it safely. Its key objectives will be: A. To advise within 6 months on the way ahead over the next 5 years to achieve hazardous waste reduction and environmentally sound management of such wastes, including advice on key decisions to be made, the timing of those decisions and encompassing consideration of targets for hazardous waste reduction. B. To identify opportunities to reduce the production of hazardous waste and the recovery of that which is produced.

Transporting Hazardous Waste from Prince Edward Island
LIKE ANY AREA OF of the industrialized world, Prince Edward Island produces dangerous or potentially hazardous waste. This material is usually shipped out of PEI on a regular basis. In 1998, there were 424 shipments sent across the Confederation Bridge to be either incinerated, landfilled, or recycled. These shipments totalled close to 490 metric tonnes and were composed of a variety of items. The most common hazardous materials shipped out of Prince Edward Island include:
  • waste paint
  • tetrachloroethylene (used by dry cleaners)
  • flammable liquids
  • naptha petroleum
  • waste batteries
  • poisonous liquids
  • occasional PCBs and aerosols
  • infectious substances
  • corrosive liquids/solids
  • pesticides
Individuals or companies producing hazardous waste are known as the generators . When they need to dispose of hazardous material, they must contact a licenced hazardous waste disposal service to pick up the waste. The disposal company will ask the generator of the waste to contact the Department of Fisheries, Aquaculture and Environment
