The West Virginia Board of Education is established in the West Virginia Constitution. The Board is vested with general supervision of the state's 834 elementary and secondary schools. Its 11 members include nine citizens appointed by the governor and two non-voting ex-officio members the State Superintendent of Schools and the Chancellor of the West Virginia Higher Education Policy Commission. The State Superintendent is a constitutional officer who serves at the will and pleasure of the board. Board members serve overlapping terms of nine years, and no more than five citizen members may belong to the same political party. The board meets monthly to determine the educational policies of the elementary and secondary schools and to establish the rules that carry into effect state law regarding education. The State Board of Education also has general control, supervision and management of the business and educational affairs of the West Virginia Schools for the Deaf and Blind. Henrico is among the six largest county public school divisions in Virginia. All schools are accredited by the Virginia Department of Education, and high schools are also accredited by the Southern Association of Colleges and Schools. The school division receives strong support from citizens and county government.
More than 41,000 students attend 41 elementary, middle , and 8 high schools , as well as 2 technical centers. High school students have a choice of attending one of nine specialty centers which focuses on rigorous academic study in a specific content area or program. The International Baccalaureate Program, one of our specialty centers, features a middle years program which is one of two in the nation.

First Amendment Court Allows Minute of Silence to Continue in Virginia Schools A federal appeals court ruled that a Virginia law implementing a mandatory minute of silence in public schools is constitutional. A panel from the 4 th Circuit U.S. Court of Appeals issued a 2-1 opinion in the case Brown v. Gilmore , rejecting a constitutional challenge to the Commonwealth’s "minute of silence" law. The Virginia law was passed in the General Assembly last year and was in place for the 2000-2001 school year. The legislation mandated that public schools must begin the school day with a minute that allowed students to meditate, pray or engage in any other silent activity. The ACLU challenged the law by filing a lawsuit on behalf of a handful of students. The lawsuit argued that the minute of silence was an attempt to encourage students to pray and therefore violated the First Amendment. The appeals panel disagreed. "By providing this moment of silence, the state makes no endorsement of religion," Judge Paul V. Niemeyer ruled in the majority opinion. "Recognizing that the Religion Clauses of the Constitution are intended to protect religious liberty, Virginia’s minute of silence is no more than a modest step in that direction."

Contact: Michael Plunkett, director of Special Collections at (804) 924-3998 or e-mail: mfp@virginia.edu In the early part of this century, Virginia spent $3.20 a year to educate African-American children, less than a third of what it spent to school white children. Black children had shorter school years than white children and black teachers earned about half the salaries of their white counterparts. Yet these inequalities don't even begin to describe the deplorable conditions under which dedicated African-American teachers labored to educate their young pupils in the opening decades of the 20th century. Those conditions, the determination of the teachers to teach and the pupils to learn can still be seen today thanks to the remarkable photographic record left by Jackson Davis. A Virginia native and white educator, Davis spent much of his career studying the educational policies of Southern states and traveling throughout the South to examine the effects of those policies on the ground. Among Davis' many achievements was the creation of a visual document of the condition of African-American education in the South in the early 1900s.

Biography of Jackson Davis
Jackson Davis was born in Cumberland County, Virginia, on September 25, 1882, the son of William Anderson and Sally Wyatt (Guy) Davis. He attended the public schools of Richmond, Virginia, and received his B. A. from the College of William and Mary in 1902 and his M. A. from Columbia University in 1908. Honorary L.L.D. degrees were conferred upon him by the University of Richmond in 1930 and the College of William and Mary in 1931. Following graduation from William and Mary he was the principal of the public schools of Williamsburg, Virginia. He was assistant secretary of the Roanoke, Virginia YMCA from 1903-1904, was principal of the public schools of Marion, Virginia from 1904-1905, and was superintendent of schools in Henrico County, Virginia from 1905-1909. From 1909-1910 he was a member of the state board of examiners and inspectors of the Virginia State Board of Education, and from 1910-1915 he was state agent for African-American rural schools for the Virginia State Department of Education. In 1915 he became affiliated with the General Education Board in New York, New York, as a field agent. Two years later he was transferred to New York city as the board's general field agent, in which capacity he remained until 1929 when he was made assistant director. He became associate director in 1933 and vice-president and director in 1946.

Model School Crisis Management Plan
Virginia's schools are responsible for the safety of more than one million students. While safety is always a priority, this responsibility takes on added urgency during times when the commonwealth and nation are threatened by terrorism. The Virginia Department of Education offers the Model School Crisis Management Plan for use by local educators and law enforcement officers in developing or refining school division-level and building-level crisis plans. The Model School Crisis Management Plan includes model policies, procedures, and forms that can be adopted or modified to meet local needs and accommodate existing resources. The pdf version of the Model School Crisis Management Plan may be viewed and printed using Adobe Acrobat. If you do not have Adobe's Acrobat Reader you may download it here. In part, the fourth commission meeting of the 1997 interim brought the commission's work around full circle to work which began in 1996 with the HJR 195 study committee, the predecessor to the commission. The universal service fund provisions of the Federal Telecommunications Act of 1996 were a major focus of HJR 195's work. With the subcommittee's recommendation, the 1997 General Assembly passed HJR 635, encouraging the State Corporation Commission (SCC) to continue its efforts to open up competition in the local exchange market among telephone, cable, and other communications companies, and HJR 444, requesting the Library of Virginia to develop a strategic information technology plan for the Commonwealth's public library system.

The SCC's report recommends that the SCC: (i) continue its long distance and local competition initiatives (begun as early as 1983); (ii) continue to monitor universal service proceedings at the Federal Communications Commission (FCC), including pending federal court cases, and take action as appropriate; (iii) allow the universal service fund to operate for at least two years before assessing the need for additional state funding; and (iv) advise the Virginia General Assembly should the need for legislation arise in the future (none is requested for the 1998 Session). The report, published as House Document No. 15 (1998), includes the SCC's order of June 30, 1997, adopting the discounts for intrastate telecommunications services established by the FCC. Adoption of these rates is a prerequisite to a state's eligibility for discounts funded by the universal service fund. The SCC was one of the public utility commissions in the nation to do so.

Virginia's new law, which is supposed to take effect on July 1, requires schools to set aside 60 seconds for students to meditate, pray or "engage in any other silent activity" that does not disrupt the class.

A new battle is under way over the long-debated issue of prayer in the schools.
The battlefield this time is the state of Virginia, where the American Civil Liberties Union has gone to court in the hopes of overturning the new Virginia law which requires a moment of silence in public schools.
Opponents of prayer in the schools regard the practice of providing a moment of silence as a tacit encouragement of prayer and as such, a violation of the constitutional separation of church and state.
The law leaves no question in the mind of Kent Wills, executive director of the ACLU's Virginia chapter. "The purpose of this law is clearly to promote state-sanctioned prayer in public schools,"
