FR 11: Enact False Claims Legislation Texas should adopt a False Claims Act to discourage fraud against public programs. Background Several states have followed the federal government's lead in vigorously attacking fraud against public programs, using false claims acts modeled after federal law to recover funds stolen from state and local governments. In California, for example, the Office of Attorney General recently recovered $1.7 million from a vendor who used false documents to defraud the state in a computer purchase. States are learning that a potential for serious fraud exists wherever public funds are spent. California's attorney general, for example, is investigating fraud in a wide range of government programs; prison construction projects are particularly ripe for fraud. Construction vendors in California have been known to substitute inferior products and fail to provide promised equipment. Federal False Claims Act The importance of preventing fraud against public programs has been underscored by the wide-ranging authority granted the U.S. Attorney General (USAG) to investigate and litigate false claims involving government programs. The federal False Claims Act prohibits "knowing" acts involving false or fraudulent claims for government payments or approval; false records or statements used to collect these claims; conspiracies involving false claims; deliberate withholding of government property legally owed to a person; false receipts given for government property; purchases of property from an unauthorized government employee; and false records or statements used to avoid paying a government debt.

The February and March Regs and Rules columns provided the addresses of web sites useful to bankers and compliance officers. Since the publication of these articles, I have heard from many of you who found these articles useful and wanted more. In the last few weeks, I have assisted several bankers by giving them answers to their questions and directing them to the applicable Texas law on one of a couple of web sites. Those sites are: Texas Legislature Online ("TLO") at www.capitol.state.tx.us and TexasLegal.com at www.texaslegal.com First, a word of warning: Texas law is complex; do not try to act as your own attorney. Although some questions can be answered by finding a particular statute, many legal issues, which at first glance may appear to be answered in a section of the statutes, can often actually require the careful consideration of many different statutes, cases, interpretive letters, and rules by an experience bank attorney. When in doubt, contact your legal counsel. TLO has links regarding the House, Senate, Legislative Council, pending legislation, the Capitol, State Agencies, and other legislative links you would expect from a legislative web site. Additionally, under the heading "Legislative Information," TLO has links to Texas Statutes and the Texas Constitution. One click on the words "Texas Statutes" gives you access to all of the Texas Statutes online.

SEC. 3.15. PROVISIONS RELATING TO CIVIL PROCEDURE. This section addresses the drafting of a bill that proposes a change or addition to civil procedure. Statutorily, the Texas Supreme Court has the power to both promulgate rules of civil procedure and repeal any legislative enactment that conflicts with the adopted rules. Section 22.004(a), Government Code , provides that the Texas Supreme Court has "full rulemaking power in the practice and procedure in civil actions." Subsection (c) of that section provides that a rule adopted by the supreme court "repeals all conflicting laws and parts of laws governing practice and procedure in civil actions." The supreme court has not hesitated to exercise its power under this section: a prime example is the court's repeal of Chapter 9, Civil Practice and Remedies Code, as being in conflict with Rule 13, Texas Rules of Civil Procedure. The only limitation on this statutory delegation is in Section 22.004(b), Government Code, which provides that the legislature may disapprove a supreme court rule or amendment to a rule. It is not clear whether the supreme court can reenact a rule that has been disapproved by the legislature. Although the legislative delegation of power to the supreme court contained in Section 22.004, Government Code, to enact rules of civil procedure and repeal laws that conflict with those rules is fairly straightforward, the constitutional provisions relating to the authority of the court to adopt rules of civil procedure are more ambiguously expressed.

Restatement of the Law Governing Lawyers Another important relationship between the Restatement and the ethics codes is that between decisional law and statutory law. The Restatement draws heavily on decisional law, while the ethics codes in almost all jurisdictions have the form and force of statutes, or at least administrative regulation. On subjects directly addressed in the ethics codes, the Restatement frequently tracks this statutory language literally, or at least without material change. In many instances, however, the Restatement significantly departs from the code formulations. Carefully considered and extensively debated, many of these departures simply clarify the underlying intention of the code provisions, while other departures seek to supersede drafting mistakes. Still other departures reflect the recognition that experience with the codes has revealed better resolutions on a variety of issues.

The Texas Legislature meets regularly in odd-numbered years for a maximum of 140 days beginning on the second Tuesday in January. Along with this 140-day session, the Governor may call one or more special sessions to consider only those matters approved by the Governor. The official “Call for the Special Session” is printed in the session laws and lists those subjects that may be considered for discussion.
