Some states, such as New Hampshire, simply weight all special education students the same in their formulas. This means that a student with a substantial physical disability has the same weight as a student with a minor reading disability if both students are enrolled in special education programs. Some states have created subcategories of special education students and provided each of those with a specific weight (e.g, South Carolina and Texas). Another approach is to weight a student based on his or her ability to spend time in a “regular classroom” (e.g., Iowa). This system provides the student a higher formula weight for the extra time he or she must spend outside of a regular classroom. A fourth approach is to provide all special education students with a single weight plus an additional weight based on the district’s financial need (e.g., New York). Letters from individuals interested and involved in the problem — parents, teachers, students, administrators, voters — have added yet more names and stories that tell of the depth and hopelessness of the current "permanent placement/black hole" process that holds special needs children in a system which seldom offers a positive or acceptable exit. Typical of the letters was communication from a retired Texas principal who stated that in twenty (20) years the only children released from special education in his district were the "speech and language" students. He also noted that, in his opinion, the "speech and language" clinicians were far better trained than the special education teachers. El Cato May 22, 2002 Prediction: IDEA Will Continue Down the Wrong Path by David Salisbury David Salisbury is director of the Center for Educational Freedom at the Cato Institute. Peter, age 12, is visually impaired. His parents wanted him to attend the Texas School for the blind in Austin, Texas, but school officials at Peter's local public school wouldn't let him. They felt they knew better than Peter's mother and father what was best for him. To most people, it seems rather patronizing for public school administrators to presume to make such a decision for Peter's parents. Unfortunately, current federal policy places government-not parents-in the primary decision-making role when it comes to children with disabilities. Since 1975, a law known as the Individuals with Disabilities in Education Act (IDEA) mandates that public schools create Individualized Educational Plans (IEPs) for children with disabilities. That may sound good, but the process for setting up an IEP is too often stacked against the parents. The process involves lengthy meetings with school officials, counselors and teachers. Disagreements over the IEP often have to be resolved in court. Consequently, only the more affluent parents-those who can afford attorneys-are able to navigate the process successfully. The children of other parents often receive little benefit from being in "special ed." Congress has an opportunity this year to turn this situation around and put parents-rather than school officials and attorneys-in control of the process. How? By replacing the contentious IEP process with pure parental choice. To do this, Congress would have to amend IDEA and allow states to adopt instead a parental choice model. In those states, parents of a special needs child could place their child in any school, public or private. The cost would be limited to what the public school normally pays for a child with a similar disability. The parents can use the local public school if they want. But they would always have the option of selecting another public or private school. Such a policy would be a tremendous victory for parents of disabled children, who now are stuck with whatever local education officials decide to provide.

While President Clinton calls for 3,000 charter schools by decade's end, his administration's lawyer-activists at the U.S. Education Department are doing all they can to savage these independent public schools of choice, now numbering around 700 nationally. First blood was drawn recently by Norma Cantu, a veteran of the Mexican-American Legal Defense Fund and now head of the Education Department's Office of Civil Rights (OCR). (Cantu's mischief was last exposed in these pages by David Tell on 8/11/97: "Norma Cantu's Cant.") Last month, Cantu's Boston office handed down two precedent-setting and outrageous rulings against the Boston Renaissance Charter School in response to allegations of discrimination by the school against a fifth-grade girl and a first-grade boy with "attention deficit disorder." Both youngsters are African-American. Here are the facts: The Boston Renaissance School, which is managed by the for-profit Edison Project on behalf of the non-profit community group that obtained a charter from the state in 1995, enrolls over a thousand students in grades K-8. Any discussion about inclusion should address several important questions: Do we value all children equally? Is anyone more or less valuable? What do we mean by "inclusion?" Are there some children for whom "inclusion" is inappropriate? There are advocates on both sides of the issue. James Kauffman of the University of Virginia views inclusion as a policy driven by an unrealistic expectation that money will be saved. Furthermore, he argues that trying to force all students into the inclusion mold is just as coercive and discriminatory as trying to force all students into the mold of a special education class or residential institution.
