This course will survey American legal history from colonial times to the end of the Civil War, emphasizing the ongoing relationship between legal development and general social, economic, political and intellectual trends. Topics to be covered in this process include the early New England legal codes, the origins of American slavery, the place of women in colonial law, the Salem witchcraft trials, the rise of the American legal profession in the eighteenth century, the impact of economic growth and industrialization on early nineteenth-century American legal doctrine, the development of the American prison system, the codification movement, and the methodology of American legal education prior to the Civil War. Evaluation will be by final examination.

2350 BC: Urukagina's Code
This code has never been discovered but it is mentioned in other documents as a consolidation of existing "ordinances" or laws laid down by Mesopotamian kings. An administrative reform document was discovered which showed that citizens were allowed to know why certain actions were punished. It was also harsh by modern standards. Thieves and adulteresses were to be stoned to death with stones inscribed with the name of their crime. The code confirmed that the "king was appointed by the gods".
2050 BC: Ur-Nammu's Code
The earliest known written legal code of which a copy has been found, albeit a copy in such poor shape that only five articles can be deciphered. Archaeological evidence shows that it was supported by an advanced legal system which included specialized judges, the giving of testimony under oath, the proper form of judicial decisions and the ability of the judges to order that damages be paid to a victim by the guilty party. The Code allowed for the dismissal of corrupt men, protection for the poor and a punishment system where the punishment is proportionate to the crime. Although it is called "Ur-Nammu's Code, historians generally agree that it was written by his son Shugli.

Introduction This Collection Policy Statement is based on the second of the Library's three "Canons of Selection" : "The Library should possess all books and other materials (whether in original form or copy) which record the life and achievement of the American people." History is generally understood to be a chronological relation of important events, usually with an attempt to explain their relationships, significance, and causes. John Higham, in his History: Professional Scholarship in America (Baltimore, Johns Hopkins University Press, 1989, p. ix.) writes, "Any story about human experience that tries to exclude fable and error in the interest of truth has a claim to the name of history." History The function of the Attorney General is an ancient one in English legal practice. The office can be documented as far back as 1277 and is probably substantially older. Most nations and states the legal practices of which are derived from British origins retain not only the function, but also the name Attorney General to describe their chief public prosecutors.
In Delaware, the office existed in rudimentary form even prior to the English era. During the Swedish period (1638-1655), the Governor did not have anyone other than himself to act as chief prosecutor and represent the public interest in civil and criminal cases. Governor Printz, in 1647, appealed to Sweden for appointment of an official who "might attend to the judicial business eliminating the unfortunate need for having one and the same person appear in the court as plaintiff as well as judge."
With the advent of Dutch rule in 1655, this situation soon changed for much of what is now New Castle County. In 1656, the Dutch took control of the region from Christina Creek to Bombay Hook and later of the entire area, establishing a far more liberal government than that which had previously existed. One of the offices which was created, Schout, combined the duties of a modern sheriff and public prosecutor, making it a rudimentary form of Attorney Generalship. The office was filled at Altenae, now Wilmington, in May, 1657, and another position was created in New Amstel, the present New Castle, in September, 1659.

Staff of the Squire Law Library History The Squire Law Library, established in 1904 and commonly referred to as The Squire , is located on three floors of the Law Faculty Building on the Sidgwick Site to the West of Cambridge. The building, designed by Foster and Partners and officially opened by H.M. The Queen on 8 March 1996, provides a stunning environment for a library and information service. Features of the Library include spacious reading areas situated on the terraced floors adjacent to the curved glass façade, extensive and historical legal collections, state-of-the-art I.T. facilities (including the Freshfields IT Centre), and the Maitland Legal History Room. The Collections The Library currently holds approximately 150,000 volumes with about 1,500 serial titles. The Squire maintains strong collections from the major common law jurisdictions including the United Kingdom, United States, Australia, Canada, and New Zealand. There are also extensive collections in International Law, Comparative Law, Conflict of Laws, the European Union and the laws of many European countries.
