in the Electronic Age

John K. Hanft is the Co-Director of the Witkin Legal Institute at West Group. He is the author of Legal Research in California, published by West Group, and is a contributing author to California Legal Assistant Handbook, published by James Publishing. The following remarks were delivered May 16th, 1998, at a symposium sponsored by the Bernard E. Witkin State Law Library of California, entitled "Shaping the Future of Legal Information." These remarks also appear in Legal Reference Services Quarterly, Volume 17 #3, pp. 77 et seq. (1999). I would like to discuss some of the challenges I see arising from electronic research, to contrast two views of legal research, and to offer suggestions for a systematic and efficient legal research methodology. CHALLENGES ARISING FROM ELECTRONIC RESEARCH In my view, electronic research, particularly internet research, presents five significant challenges for legal researchers.

    Questions And Answers: Final Regulation On "Tender Back" and Related Issues Concerning ADEA Waivers
    Introduction
    What is a waiver under the Age Discrimination in Employment Act? As a general matter, a waiver under the Age Discrimination in Employment Act of 1967 (ADEA) is a legal agreement between an employer and employee in which the employee gives up the right to pursue an age discrimination claim against the employer in exchange for something of value, often severance or early retirement benefits. For example, during a layoff, an employer might ask that an employee agree to give up whatever ADEA claims he or she may have against the employer in order to get severance benefits. How does the ADEA govern waivers? In 1990, Congress passed the Older Workers Benefit Protection Act (OWBPA) as an amendment to the ADEA. Title II of the OWBPA established certain minimum requirements that must be met in order for an ADEA waiver to be valid. What were Congress's purposes in enacting the waiver provision in the OWBPA? Congress enacted the waiver provision in order to resolve a debate over whether employers could ask older workers to waive their ADEA rights. Understanding that waivers are typically tied to the receipt of important economic benefits, Congress determined that employers could obtain waivers but, in order to protect workers' rights, Congress also imposed requirements with which waivers would have to comply.

    Brief Overview and History of Various Employee Laws
    There are a variety of federal laws, executive orders, etc., regarding the selection and treatment of individuals in the workplace. Most notable are federal laws established by the Civil Rights Act of 1964, designed to ensure equal employment opportunity (EEO). Numerous EEO guidelines are intended to provide equal opportunities without regard to race, religion, origin, sex, age or disability. The guidelines also established requirements for affirmative action, specifying that employers had to take proactive measures to ensure equal opportunity to certain protected groups. Various other laws are designed to ensure safety in the workplace, fair pay standards and fair treatment of employees providing military service.

    he work of the federal courts touches upon many of the most significant issues affecting the American people, and federal judges exercise wide authority and discretion in the cases over which they preside. This section discusses how federal judges are chosen, and provides basic information on judicial compensation, ethics, and the role of senior and recalled judges.
    Justices of the Supreme Court, judges of the courts of appeals and the district courts, and judges of the Court of International Trade, are appointed under Article III of the Constitution by the President of the United States with the advice and consent of the Senate. Article III judges are appointed for life, and they can only be removed through the impeachment process. Although there are no special qualifications to become a judge of these courts, those who are nominated are typically very accomplished private or government attorneys, judges in state courts, magistrate judges or bankruptcy judges, or law professors.
