Disabled are top voucher users
McKay Scholarships may double this year, but few students are using vouchers to escape failing schools.

published September 13, 2002 School voucher programs are expected to divert about $56-million from Florida public schools to private schools this year, roughly twice the amount spent last year. But relatively few students are using the most controversial vouchers. The vast majority of the money is going to the McKay Scholarship program for disabled children, a program often overshadowed by the state's original voucher program for children at public schools deemed failures by the state. The McKay program has attracted more than 7,000 children this year, and state officials expect the number to be close to 8,000 as additional applications are processed. That would amount to nearly a two-fold increase over last year. As dramatic as the McKay Scholarship numbers are, just as surprising is the small number of children who used vouchers to leave failing schools.

Parents who feel their child's needs are not being met by public school systems' special education programs are eligible for taxpayer-funded scholarships to send their child to a private school.
Effective this school year, disabled students may attend a different school if they have failed to reach two goals in their individualized educational plan. The plan, called an IEP, is the document that guides the education of all exceptional education students.
Parents are responsible for proving that their child has not met expected educational improvements, said Mark Cashen, general director of exceptional student education for Duval County public schools.
Applications will be reviewed by a committee to determine if the student is eligible for the scholarship, Cashen said.
The application deadline for the program was originally set at Aug. 1, then extended to Aug. 15. But yesterday Education Commissioner Tom Gallagher waived the cutoff to allow more parents and private schools the chance to participate.
"This vital program will serve students with disabilities throughout Florida who are in need of educational assistance," Gallagher said. "Our goal is to inform parents and notify private schools, so students can receive the best education available."

With little fanfare, Florida's newest voucher program has begun to take hold in isolated school districts, as dozens of special education students have transferred to private schools at the state's expense.
In Pinellas and Hillsborough counties, about 18 learning disabled children are participating in the program this school year.
"As far as we're concerned, the program is up and running," said Eric Larson, president of Center Academy, which is schooling voucher students at one site in Palm Harbor and one in Lutz.
Even as the program has gotten under way, there are concerns about who will be held liable if a "special needs" child does not receive the services he is entitled to under federal law. School board attorneys from throughout the state are worried their districts will be held responsible, even if a parent choses to take his or her child to a private school. On Monday, school board attorneys from around Florida will meet in Tallahassee to discuss the issue.
"It's our position that parents don't give up their rights to a free and appropriate education when they enter this program," said John Bowen, attorney for the Pinellas County schools.

The Need for New Options For Children With Disabilities In 2001, the Thomas B. Fordham Foundation and the Progressive Policy Institute teamed to release a collection of studies titled Rethinking Special Education for a New Century The number of students in special education nationwide has grown 65 percent since the inception of the Individuals with Disabilities Education Act (IDEA), to about 6.1 million in the 1999-2000 school year, or 8.2 percent of the overall student body. The largest growth has been in the percentage of children classified as learning disabled which was 21 percent when the law was passed and 46 percent in 1998. The Economic Policy Institute estimates that 38 percent of each new tax dollar raised for public schools has been spent on special education.

Last week's Supreme Court ruling to permit funneling tax dollars through parents to private and religious schools does not mean that vouchers are the "law of the land." The ruling only shifts the battle to state legislatures, and to courts over state constitutional prohibitions on using tax dollars to support religious institutions. The voucher decision may also accelerate efforts to amend state constitutional prohibitions, though voters have been hostile to schemes to divert funding from public to private schools, the vast majority of which are church-run schools. In November 2000, voters in Michigan and California overwhelmingly rejected efforts to remove their state constitutional prohibition on private and parochial school vouchers. According to the Florida Constitution: "No revenue of the state or any political subdivision or agency thereof shall ever be taken from the public treasury directly or indirectly in aid of any church, sect, or religious denomination or in aid of any sectarian institution." This provision has been part of our State's Constitution since 1885. I await the legal gymnastics of the Governor's lawyers when they try to persuade Florida courts that the words don't mean what the framers intended.

My professional interests focus on working with infants, toddlers and young children with special needs. Specialty areas are with physical/severe disabilities, medical/health needs, transition and functional curriculum. I serve on various campus committees and on a variety of local and state organizations which serve the disabled. I have served on the Board of Directors of the Central Virginia Association of Retarded Citizens (Vice President, 1998). Other memberships are currently with Lynchburg City Schools Special Education Advisory Committee, Mabel Rush Housing Foundation and Early Intervention Council of Central Virginia. I currently teach: Language Development and Communication Skills for Learners with Disabilities (EDHD 451) , a study of language development and sociocultural variations in individuals with disabilities. Instructional techniques and intervention programming (i.e., alternative communication systems) for students with disabilities will be explored. The course will also include attention to curricula, methods and materials in language arts.
