One Florida Plan Passes 1st Test By: Scott Powers The Orlando Sentinel April 14, 2001 Florida’s ban on race-based college admissions hasn’t reduced the number of minorities accepted into the University of Florida’s law school next fall. UF’s Levin College of Law just finished picking next fall’s new law students, the first under Gov. Jeb Bush’s One Florida plan that forbids public universities from considering race, ethnicity or gender when picking students. The university found its proportion of blacks and total minorities is about the same as last year, officials said Friday. The newly accepted UF class draws sharp contrast with California and Texas law schools. They saw black and Hispanic admissions plummet in 1997, the first year those states abolished racial preferences. The One Florida plan was first applied to undergraduate admissions for last fall, but it came too late in the year to have much effect. For undergraduates, One Florida was accompanied with an alternative policy called Talented 20, which guaranteed college admission to the top 20 percent of students at each public high school. One Florida will apply to all graduate and professional schools for the first time next fall, with no alternative plan to buffer the impact. Law schools are considered the most likely to struggle for diversity because they traditionally relied more heavily on racial preferences.

What is public school choice? School choice is the practice of allowing parents to choose from among a variety of schools. Options that supplement public schools include magnet schools, schools-within-schools, alternative schools, year-round schools, dual enrollment, and controlled open enrollment. In Florida, "controlled open enrollment" means a public education delivery system that allows school districts to make student school assignments using parents' indicated preferential school choice as a significant factor. Scholarship programs are authorized to assist students in pursuing post-secondary education and training opportunities. The examples are abundant. 1. School officials in Broward County are spending millions of dollars to reduce first-grade class sizes to 18-20 students per class in 104 low-performing schools. An associate superintendent told the local newspaper, "Contrary to public opinion, the schools have really been energized by this [grading system]. They are determined to improve their scores." 2. In Hillsborough County, schools superintendent Earl Lennard made statewide news recently when he vowed to take a 5 percent pay cut, or a personal loss of $8,250, if any school in Hillsborough County receives an F grade. To meet this high expectation, Lennard promised his schools the support they need, including reduced class sizes for select "D" schools and money for after-school or Saturday tutoring at all schools. 3. In Pensacola, where students at two chronically failing schools have been given Opportunity Scholarships to attend the public school or private school of their choice, Superintendent Jim May posted a hand-lettered sign in his office that reads, "Non-negotiable aim is: Both schools must come off the F list. State Application (.pdf) Juvenile Justice Probation and Community Corrections Links A youth under age 18 charged with a crime is referred to the Florida Department of Juvenile Justice. A referral is similar to an arrest in the adult criminal justice system. In Fiscal Year 1999-00, the Department received 56,447 referrals for juvenile felonies and 84,252 referrals for juvenile misdemeanors. Those 140,699 delinquency referrals represented a 1.4 percent increase from the previous year (felonies dipped very slightly, 6/10 of a percent; misdemeanors rose 2.8 percent). The five-year trend shows a 9 percent decrease in juvenile felony referrals since FY 1994-5, and a 2 percent drop in misdemeanor referrals during that same period. The Department provides a recommendation to the state attorney and the court regarding appropriate sanctions and services for the juvenile. The recommendation is based on interviews and information from the arresting law enforcement officer, the victim, the juvenile and his or her family, and other sources (school, for example). When making a recommendation, the Department has several options that allow the juvenile to remain in his or her home community. One is diversion, which uses programs that are alternatives to the formal juvenile justice system. It is for juveniles who’ve just started offending and have been charged only with minor crimes. Another is court-ordered juvenile probation.
