To State Agency and Local Government Officials, Administrators, Counsels, and Staff: I am pleased to present the 2002 Administrative Law Handbook , published by the Office of the Attorney General. This handbook covers three state statutes: the Administrative Procedure Act, the Texas Public Information Act, and the Texas Open Meetings Act. The handbook is intended as an overview and introduction to these Acts. Although not a substitute for legal advice, it can assist in pointing out statutory requirements and directing users to a course of action. The Office of the Attorney General also publishes detailed handbooks on the Public Information and Open Meetings Acts. Information on how to access these handbooks on the Internet and to order a hardcopy is located on page one of this handbook. The Administrative Procedure Act applies primarily to state regulatory agencies. These agencies have a significant impact on the lives of all Texas residents. Texans expect and deserve the highest quality services state government can provide. As your Attorney General and legal counsel for the State of Texas, I am committed to providing state agencies the best possible legal advice and support. Toward this goal, I offer this handbook as a means of helping you and your staff to become familiar with and understand the basic tenets of the Act. Can Do for You
The Attorney General is the constitutional, statewide elected official who acts as the attorney for the State of Texas. The Attorney General:
  • enforces state consumer protection laws; collects court-ordered child support; and administers the Crime Victims' Compensation Fund.
The Attorney General also serves as legal counsel to boards and agencies of state government, issues legal opinions when requested by authorized requesters, and sits as an ex-officio member of various state committees and commissions. He defends challenges to state laws and defends both state agencies and individual employees of the State when they are sued. The Attorney General files civil and criminal suits upon referral by other state agencies, and in some circumstances, he has original jurisdiction to prosecute violations of the law without a referral from another agency. How we can help you Many Texans look to the Office of the Attorney General for guidance with disputes and legal issues. This agency receives hundreds of letters, phone calls and visits each week about crime victims' compensation, child support, abuse in nursing homes, possible consumer fraud, and other topics. We can and do answer many of these questions directly. We can send you an application for crime victims' compensation, for example, or for child support services. In some cases, we may refer you to another agency that serves your particular need. Under Texas law, however, we cannot give you legal advice or answer questions about particular laws or statutes. We have Regional Reporter, New York and California sets as well but they are current only through September 2002. For cases not covered by our print collection we provide electronic access via Shepard's, LoisLaw and West's LawDesk. Finding Laws

To locate statutes on a particular topic, start with the index to the annotated code for your jurisdiction. An annotated code is one that includes, in addition to the full text of the statutes, brief summaries of cases interpreting a statutory provision and citations to other research material such as law review articles, legal encyclopedias, and administrative regulations. All states and the federal government have at least one annotated code. The index will direct you to the section or sections within the code where statutory provisions on your topic are located. Code Citations
A citation to a code section acts like an address. In the United States, most jurisdictions organize their current laws of general application into "codes" arranged by subject. Each subject grouping is given a name, for instance, "Corporations," and a number, for example, "Title 10." The main difference between a code cite and a case cite is that you will be referred to a "title" or "chapter" of the code and a "section" within the title or chapter instead of a volume and page number of a case reporter.

III. Core Function: Legal Representation, Enforcement of Federal Laws, and Defense of U.S. Interests
As the Nation's litigator, the Department is the the largest "law office" in the world. Working together, Department components ensure that the Federal Government "speaks with one voice" with respect to the law. In 1998, the Department worked to address several of the Attorney General's top priorities, including enforcing the Nation's environmental, tax, civil rights, and antitrust laws; putting a stop to the proliferation of hate crimes; protecting the public fisc; defending challenges to the Federal Government's regulations and initiatives; and focusing on litigation with international implications.
Goal 3.1: Protect the Civil Rights of All Americans.
The civil rights laws of the United States prohibit discrimination on the basis of race, color, religion, sex, national origin, disability, age, familial status, and citizenship status in employment, education, public accommodations, housing, lending, programs receiving Federal financial assistance, and in other areas. The Civil Rights Division (CRT) serves as the Federal Government's chief guardian of these rights. Worker exploitation is another area where the Department has increased its involvement, having observed an increase in these cases. The Attorney General in April 1998 approved the creation of an interagency Worker Exploitation Task Force. This task force is co-chaired by the Acting Assistant Attorney General for Civil Rights and the Solicitor of Labor. The task force is investigating a number of potential worker exploitation cases, has a number of cases under indictment, and has coordinated a wide-ranging training program on worker exploitation for investigators from a number of agencies.

    bankruptcy: an overview
    Bankruptcy law provides for the development of a plan that allows a debtor, who is unable to pay his creditors, to resolve his debts through the division of his assets among his creditors. This supervised division also allows the interests of all creditors to be treated with some measure of equality. Certain bankruptcy proceedings allow a debtor to stay in business and use revenue generated to resolve his or her debts. An additional purpose of bankruptcy law is to allow certain debtors to free themselves (to be discharged) of the financial obligations they have accumulated, after their assets are distributed, even if their debts have not been paid in full. Bankruptcy law is federal statutory law contained in Title 11 of the United States Code. Congress passed the Bankruptcy Code under its Constitutional grant of authority to "establish. . . uniform laws on the subject of Bankruptcy throughout the United States." See U.S. Constitution Article I, Section 8.

    environmental law: an overview
    The National Environmental Policy Act (NEPA) was passed in 1970 along with the Environmental Quality Improvement Act, the Environmental Education Act, and the Environmental Protection Agency (EPA). The main objective of these federal enactments was to assure that the environment be protected against both public and private actions that failed to take account of costs or harms inflicted on the eco-system. The EPA was supposed to monitor and analyze the environment, conduct research, and work closely with state and local governments to devise pollution control policies. NEPA (really enacted in 1969) has been described as one of Congress's most far reaching environmental legislation ever passed. The basic purpose of NEPA is to force governmental agencies to consider the effects on the environment of their decisions. State laws also reflect the same concerns and common law actions in nuisance allow adversely affected property owners to seek a judicial remedy for environtal harms harms.

    Introduction
    The following material serves as an entry level introduction to the compilation of Federal laws and regulations, their relationship to each other and where they may be found. The internet sites shown below may be accessed to obtain more detailed or specific information about Federal laws and regulations.
    The Distinction Between Laws and Regulations
    The difference between laws and regulations are sometimes misunderstood. Congress, and only Congress, enacts laws. Federal executive departments and administrative agencies write regulations to implement the authority of laws. Regulations (as well as Executive Orders and Proclamations) are ancillary or subordinate to laws but both laws and regulations are enforceable. The U.S. Code is the official compilation of codified laws by subject, the U.S. Statutes-at-Large is the official chronologic compilation of all laws, and the Code of Federal Regulations is the official compilation of regulations.
    Slip Laws
    When Congress enacts a law (titled "An Act"), it is first published as a slip lawa pamphlet print of each law enacted by Congress issued a few days after a bill becomes law. Slip laws carry the Statutes-at-Large page numbers that will be their permanent citation in a future Statutes-at-Large volume, marginal notes and citations, including U.S. Code classifications of current legislation, and guide to legislative history which also contains dates of related Presidential statements.

    Another word of caution is in order: The laws of each state are different. The following Pennsylvania statutes, though available instantaneously over the web, may not be the current law. We attempt to post statutes which have not been repealed as of the date of posting, which date usually is referenced at the bottom of each page. However, court decisions overturning them, later statutes amending them, and a host of other factors come into play when interpreting them. They are provided here as a resource.
    For over six years this website has made available, free of charge, legal information which we believe is valuable to a wide variety of users and is nowhere else available on the web. Every month over 10,000 people use it. However, the work is not funded by any government subsidy. Therefore, requests for printed copies of these statutes or for ones not yet posted here cannot be filled. Similarly, we cannot provide free legal research services or provide free legal opinions.
