Trevor Gallahan's father is going to jail. He has not been charged with any crime. He is not behind in child support. He has not battered anyone. Yet Ken Gallahan could conceivably remain in jail for the rest of his life. What is his infraction? He does not have $15,000 to pay a lawyer he never hired. He was already jailed indefinitely when he could not pay a psychotherapist he also had not hired and was released only when his mother paid the fees.
Debtors' prisons were theoretically abolished long ago, but this does not stop family court judges from using the bench to shake down fathers who have done nothing wrong and funnel everything they have into the pockets of the court's cronies. In fact the looting and criminal-ization of fathers like Ken Gallahan is now routine in divorce courts.
Family courts are the arm of the state that routinely reaches farthest into the private lives of individuals and families, yet they are answerable to virtually no one. By their own assessment, according to Robert W. Page of the New Jersey Family Court, "the power of family court judges is almost unlimited." Others have commented on their vast and intrusive powers less charitably. Malcolm X once called family courts "modern slavery," and former Supreme Court Justice Abe Fortas termed them "kangaroo" courts. One father was told by a judicial investigator in New Jersey, "The provisions of the US Constitution do not apply in domestic relations cases, since they are determined in a court of equity rather than a court of law."

BRASELTON and MILLARD provide legal representation in all areas of Family Law, including but not limited to: Adoption and Surrogacy See Our web site at adoption-law-illinois.com Simple, Uncontested Divorce Agreements Sometimes the parties to a divorce or a separation are in complete agreement as to the division of their marital estate and fully understand all issues associated with custody, child support and visitation. In those cases, a client meets with a lawyer who in turn drafts the necessary legal documents. Simple, uncontested divorces often require only one court appearance. Contested Divorce and Litigation When parties cannot agree on exactly how they wish to divide marital assets and debts, the courts consider the case "contested." Sometimes such matters can be mediated. Other times the parties must go through a process known as “discovery.” Discovery is a legal term used by the Courts and refers to the various methods used by attorneys to ascertain the value of the marital estate. Discovery methods include depositions, written interrogatories, subpoenas and demands for the production of certain documents. Often, one spouse is far more knowledgeable about family finances than the other spouse. In those cases, full disclosure of all assets and liabilities is critical in order to make an evaluation of each party’s rights.

For more art work, check out " What You Can Do D uring the days of slavery, Sojourner Truth, an escaped slave and fierce warrior for the equality and freedom of African Americans and women, once spoke before a very hostile audience. After her speech, a man approached her and said, "Sojourner do you think I care about slavery, why I care about slavery as much as I care for a flea on my arm." And Sojouner, in her simple eloquence, told the rude man: "Well sir, with any luck, I'll keep you scratchin."
For the last four years, Family Rights and Dignity (FRD) has kept the policy makers and politicians of San Francisco scratchin. FRD scrutinizes and intervenes in the practices and policies of institutions routinely impacting low income families: welfare, Child Protective Services (CPS), public housing, health services, and shelters. It is a place where low income families may fight back and give voice to that which injures them.
In every arena, FRD demands and achieves salient changes. Before the creation of FRD, low income families were systematically marginalized in the political arena. Homeless and low income families were disregarded as a politically disposable community. In contrast to single adults, families suffered subordinated access to shelter, treatment, and housing. But, as a result of FRD's hard work, drug treatment slots for families increased throughout San Francisco by 100%, and the number of subsidized units for low income families expanded by 20%. In addition, the San Francisco Housing Authority established a special transfer policy for mothers in violent or domestic violence situations, emergency shelters terminated their nightly expulsion policy, and CPS workers agreed to being trained by current or former CPS clients. Most importantly, Family Rights and Dignity has truly made low income families a political priority.

ALFRA knows we need to change the "winner takes all" divorce process in the court system, and have the courage to do what is REALLY in the children's best interests. Should You Get Involved? There are many "reasons" and excuses people make to NOT get involved. You should know why this issue should be important to you, and why you should act today to change the current system. EVERYONE can make a difference! Join ALFRA and get involved today! Our Primary Objective Our primary objective is to promote EQUAL legal rights and responsibilities for fathers and mothers who divorce, and joint parenting whenever possible. Extended Breastfeeding and the Law
By Elizabeth N. Baldwin, Esq.
There is no evidence that breastfeeding a child beyond infancy is harmful. Quite the opposite is true: breastfeeding benefits toddlers and young children, both nutritionally and psychologically. Over the past year, mothers have expressed growing concerns about the legality of extended breastfeeding. And with little wonder. The media has been giving more and more publicity to the subject, and social service agencies throughout the United States have been addressing these issues in their cases. Rest assured, however, breastfeeding is not child abuse or neglect, and no reported decisions to date claim that it is. To the contrary, upon learning of the normalcy and frequency of extended nursing in this country, several social service agencies have closed out cases involving breastfeeding. A Minnesota mother was accused of abuse for nursing a six year old in public. In reality, she was nursing a three year old; and as soon as the child's age was established, the case was closed. In Tennessee, accusations against a mother nursing a four and a half year old were dropped. In Florida, a mother was cleared of abuse for nursing a six year old!

Improving Scottish Family law 5 Parental Responsibilities and Rights: Unmarried Fathers 5.1 Introduction 5.2 Historical background 5.2.1 Before this century, fathers had custody rights in respect of Scottish children born within wedlock, and the mothers generally did not. The reverse was true of children born outside marriage. Successive Acts during the twentieth century have removed the disabilities suffered by children born outside marriage, and have removed the legal inequalities between mothers and fathers. Most recently there has been a marked shift away from the concepts of parental rights and towards the responsibilities parents have for their children, and indeed the rights of the children themselves. 5.2.2 There is now no difference between fathers and mothers in the eligibility to have parental responsibilities and rights in Scotland, where the parents are married to each other (or have been married to each other at any point since the conception of the child). However, in the case of unmarried parents, the Children (Scotland) Act 1995 confirmed that only the mother has parental responsibilities and rights automatically. The father is eligible to acquire them, but this must be either by marrying the mother, by signing a Parental Responsibilities and Parental Rights Agreement
