Ain't No Justice in Ohio
The Cincinnati Post says racism and sexism that have left Ohio's juvenile justice system in "shambles". http://www.cincypost.com/2003/03/13/juvy031303.html Report: Juvenile justice racist, sexist
By Paul A. Long
Post staff reporter Ohio's juvenile justice system is a shambles, rife with reports of sexism and racism, where children with minor school problems or mental disabilities are treated like hardened criminals, and a lock-'em-up attitude pervades, according to a report released today by the Children's Law Center. The Covington-based group surveyed hundreds of people involved in the system from judges and lawyers to incarcerated youth and watched juvenile court proceedings in 12 Ohio counties for the 64-page study. Particularly striking is the report that children often are processed through the system with either no attorney, or an attorney who is unprepared and unfamiliar with the case.
"Despite the best intentions of many, the juvenile indigent defense system in Ohio is broken and sorely in need of repair,'' said Patricia Puritz, director of the American Bar Association Juvenile Justice Center. Although the U.S. Supreme Court ruled more than 35 years ago that juveniles charged with crimes are entitled to the same legal protections as adults in the criminal justice system, that is not a reality in Ohio, the study shows.

When a youth is detained, he or she may take a confusing variety of paths. Considerable discretion about how the case is handled can be exercised by law enforcement agents, detention officials, district attorneys and judges. Many cases are diverted to social service agencies without court intervention. Jurisdiction over Juvenile offenses varies from state to state, often residing with county or municipal family courts, which can place the youth on formal probation or in a variety of out-of-home settings. Legal fees vary and can depend mostly on the type of criminal charges your child is facing. Representation for a felony is more expensive than for a misdemeanor. Another factor can be the degree of expertise the juvenile defense lawyer possesses. Typically, highly qualified attorneys who have substantial trial experience will cost more than those that don't. It's the age-old truth that you get what you pay for. Juvenile defense lawyers are no exception. Many juvenile defense lawyers require a sizable fee before commencing work on your case. This can present a problem if you do not have immediate access to money or if money is tied up in investments such as stock or real property. It is especially troublesome when you need to act quickly to retain your attorney. Often, obtaining valuable information on your case will depend on when you hire your defense lawyer. Sooner is almost always better than later.
