AV Links NEWARK-The New Jersey man accused in April of unleashing the "Melissa" computer virus pleaded guilty today to both state and federal charges, admitting that he created and spread the virus that caused millions of dollars in damage, U.S. Attorney Robert J. Cleary and State Attorney General John Farmer Jr. announced. David L. Smith, 31, of Aberdeen Township in Monmouth County, appeared in state Superior Court and later in U.S. District Court to enter his pleas. Smith admitted spreading the Melissa virus, which infected more than one million personal computers in North America and disrupted computer networks in business and government. Smith acknowledged in his federal plea agreement that the Melissa virus caused more than $80 million in damage. Smith, who was arrested by New Jersey authorities on April 1, 1999, pleaded guilty before state Superior Court judge John A. Ricciardi in Freehold to a one-count accusation charging him with knowingly spreading a computer virus with the intent to cause damage. Smith faces a maximum prison sentence of five years a $250,000 fine on the federal charge. U.S. District judge Joseph Greenaway Jr. set sentencing for May 15. Smith remains free on bail pending sentencing. The guilty pleas are the result of a joint state and federal investigation, ending in separate by coordinated prosecutions. The state plea agreement provides that the federal sentencing will occur first and that, at the subsequent state sentencing, New Jersey authorities will recommend that the state sentence run coterminously and concurrently to the federal sentence.

    UC, CSU, ATTORNEY GENERAL WIN PRELIMINARY INJUNCTION AGAINST ENRON ENERGY SERVICES The University of California and the California State University today won a preliminary injunction preventing Enron Energy Services from unilaterally jettisoning the two university systems as direct access electricity customers. U.S. District Court Judge Phyllis Hamilton, ruling from the bench in San Francisco, issued the preliminary injunction effective immediately. California Attorney General Bill Lockyer filed a friend of the court brief on behalf of the two universities and appeared in court to argue for issuance of the preliminary injunction. The CSU, UC and the attorney general argued that Enron could not legally breach its contract merely because the changing economic picture for power in California made it less financially attractive for Enron to continue to honor the contract. CSU and UC also argued that removing them as direct access customers lessened their ability to manage their power use in the most sophisticated manner possible to lighten the load on the state's electricity grid. They also said Enron's attempt to abrogate the contract had the potential for costing California taxpayers millions of additional dollars. Enron signed the four-year contract to provide electricity at predetermined rates in 1998; it is due to expire on March 31, 2002.

    www.IllinoisLegalAid.org and www.IllinoisProBono.org These web sites are building an online community of legal professionals who represent low income Illinois residents by providing online multi-media training and practice support tools, volunteer recruiting, discussion forums, a legal services community calendar, searchable directories of legal services-related organizations and staff, and legal services news and jobs. The web sites, which were developed with generous funding from the Lawyers Trust Fund of Illinois, the Chicago Bar Foundation, Chicago-Kent College of Law and the Legal Services Corporation, will help increase access to justice in Illinois by streamlining the delivery of free and low cost legal services.

    12- MONTHS INCARCERATION; $15, 000 RESTITUTION DATE: March 9, 2001 RELEASE TIME: Immediate New Hampshire Attorney General Philip T. McLaughlin, FBI Special Agent in charge Charles S. Prouty and United States Attorney for New Hampshire Paul Gagnon announced that 18-year-old Dennis M. Moran of Wolfeboro, New Hampshire was sentenced today by the Carroll County Superior Court for three computer crimes of unauthorized access to computer systems. Moran, also known by his on-line name "Coolio," received a sentence of 12 months incarceration, 3 months suspended, and he was ordered to pay restitution to the victims of his crimes in the total amount of $15,000. After the sentencing hearing, Moran was remanded to the custody of the Carroll County Sheriff's Office to begin serving his term of incarceration. The State recommended this sentence to the court based on a negotiated plea announced in January 2001. The first charge against Moran related to his computer hack into the Website of DARE America, an anti-drug abuse organization based in California. In November 1999, Moran illegally accessed the Website, DARE.com, and defaced the site with pro-drug abuse slogans and images, including one of Donald Duck with a hypodermic syringe in his arm. The DARE case was predicated on investigative work by the Los Angeles division of the FBI and the Los Angeles Police Department, who referred the matter to the New England FBI and New Hampshire authorities after discovering that the computer intrusion originated in New Hampshire.

    March 15, 2000 Recently, Christine Gregoire, attorney general of the State of Washington, released results of her office's tabulation of the most common consumer complaints of Washingtonians. According to Hope Tuttle, the attorney general's director of consumer affairs, the communications industry earned the distinction of being at the top of the consumer complaints list, with spamming (the mass sending of unwanted e-mail advertisements) being the main source of complaints within this category. In a ruling on Tuesday, a county Superior Court judge dealt a blow to Washington State consumers, as well as to the state's tough anti-spamming law, when he ruled that regulation of e-mail by the state was unconstitutional.
