Home Protecting Consumers Safeguarding Children Seniors ... Site Map History of the Family Violence Council The Family Violence Council was created in November, 1995 by Attorney General J. Joseph Curran, Jr. and former Lt. Governor Kathleen Kennedy Townsend to develop a coordinated systems approach to family violence. They invited representatives from the systems that respond to family violence - judges, legislators, police chiefs, sheriffs, court commissioners, State's Attorneys, parole and probation officials, battered women's advocates, children's advocates, law professors, family law lawyers and other policy makers - to analyze the systemic problems, devise solutions and work to implement the solutions. Council members recruited others with expertise in the field to help with the task. The Council began as a group of five working committees, each focused on specific responses to domestic violence. The Initial Response Committee examined those systems that first respond to family violence such as police, 911 operations, shelters and emergency rooms. The Civil Process Committee looked at the civil courts' response to victims seeking protection through ex parte and protective order proceedings as well as custody and visitation issues. The Criminal Process Committee covered the criminal courts and related systems' responses. The Juvenile Process Committee examined the relationship between domestic violence and child abuse and neglect proceedings, and the Post-Disposition Committee covered responses in systems such as parole and probation and abuser intervention programs.

SACRAMENTO: Governor Gray Davis today announced the appointments of Shelleyanne W. L. Chang, Michael P. Kenny, and John P. Winn as Judges of the Sacramento County Superior Court.
Ms. Chang, 42, of Sacramento, is the Chief Deputy Legal Affairs Secretary for Governor Davis. In that capacity, she reviews the work product of other attorneys in the Governor's office, advises the Governor and his staff on legal issues and pending litigation, provides direction to the Attorney General's office on litigation involving the Governor, and reviews and analyzes proposed legislation. Ms. Chang has also been one of the primary attorneys representing the State on Indian gaming issues and was one of four attorneys on the Governor's negotiating team that negotiated and drafted the Tribal-State Gaming Compacts with 61 Indian tribes in 1999.
Before joining the Governor's office in March 1999, Ms. Chang was a Deputy Attorney General from 1993 to 1999. In that capacity, she handled litigation on behalf of the state constitutional officers, state pension systems, and the California Department of General Services. She also served as bond counsel for the California Housing Finance Agency and was a member of the Attorney General's Tobacco Litigation Team. Between 1985 and 1993, Ms. Chang worked in the Office of Chief Counsel of the Internal Revenue Service, where she represented the Commissioner of Internal Revenue before the United States Tax Court and United States Bankruptcy Courts in all areas of federal tax law.

Digest FTC Wants Congress To Mandate Health Warnings On Cigar Labels, Ban Cigar Ads on Radio and Television C igar labels should include health warnings and cigar ads should be banned from radio and TV, the Federal Trade Commission urged in a report released July 21. The agency recommended that Congress enact legislation to treat cigars the same as cigarettes and smokeless tobacco. The report grew out of a study the FTC conducted last year on cigar sales and expenditures for advertising and promotion. The agency required five major cigar makers to file "special reports" on sales and ad costs for 1996 and 1997, a time when cigar smoking took a huge jump in popularity. The study found substantial increases in advertising and promotion expenditures in that period. Total expenditures increased 32 percent, from $30.9 million in 1996 to $41 million in 1997. Conventional advertising was up 51 percent; magazine advertising was up 49 percent; and newspaper advertising jumped 254 percent. Internet advertising rose 180 percent, from $78,000 in 1996 to over $218,000 in 1997. The study also revealed that over 75 percent of the cigar industry's marketing costs were for "nontraditional" forms of promotion such as discounts to retailers, celebrity endorsements, and product placements in movies and television shows.

National Tribal Justice Resource Center

Unlike the federal and state judiciaries, tribal judiciaries have not had access to a national resource center to assist them with materials and guidance to help to improve the operation of tribal courts. The need for a tribal justice center was documented in the 1978 National American Indian Court Judges Association (NAICJA) study entitled Indian Courts and the Future. The unmet need for a resource center was raised again in 1988 during testimony presented at the “working conference on court systems in Indian Country” and the U.S. Senate Select committee on Indian Affairs hearings on Indian tribal court systems and the Indian Civil Rights Act. In June of 1998, NAICJA’s Executive Committee again proposed the development of the resource center in a meeting with Attorney General Janet Reno. With the awarding of the technical assistance grant to NAICJA, the National Tribal Justice Resource Center (Resource Center) finally became a reality after decades of work and advocacy.
On September 1, 2000, the Resource Center opened its doors and became a source of daily support and technical assistance to Native American and Alaska Native tribes for the development and enhancement of tribal justice systems. The Center initially shared office space with the National Indian Law Library (a project of the Native American Rights Fund) in Boulder, Colorado, but has now moved into its own offices at 3333 Iris Avenue in Boulder, CO. For the first time in history, many of the key organizations that provide training and technical assistance to tribal justice systems will be working together to pool resources and assess the need for new ones.

Since time immemorial, Native American and Alaska Native tribes have been keeping the peace and administering justice in their homelands through the use of their own ancient laws, traditions and customs. Historically, the United States federal government has recognized the inherent sovereignty of Indian nations to “make their own laws and to be ruled by them.” (Williams v. Lee, 358 U.S. 217, 1958.) Traditionally, most tribes resolved disputes and addressed criminal activity by consensus, not by an adversarial system, as do Anglo-Americans. While each of the more than 560 federally recognized tribes in the U.S. possesses traditional methods of dispute resolution, formal court institutions are a relatively recent development in Indian Country.
The development of tribal courts as they are now known can be traced to a case arising in the 1880’s on land that is now the Rosebud Sioux reservation in South Dakota, when a Lakota tribal member, Crow Dog, killed a fellow tribal member, Spotted Tail. At the time, there was no formal court system utilized by the Lakota people. Utilizing traditional methods of dispute resolution, the tribe required Crow Dog to provide restitution to Spotted Tail’s family in the form of goods and provisions. Although the victim’s family was satisfied with the resolution, in the eyes of the federal government, the tribal approach did not inflict what it thought was appropriate punishment. As a consequence, the Department of the Interior, the federal agency responsible for directing Indian affairs, set up “Court of Indian Offenses” to handle less serious criminal offenses and to resolve disputes between tribal members through the application of federal law and regulations-not tribal law or custom.

    Chairman Tauzin, Congressman Markey, and other Members of the Subcommittee, I want to thank you for this opportunity to provide the Department of Justice’s law enforcement perspective on foreign ownership interests and foreign government ownership interests in the American communications infrastructure. Let me begin by noting that the soaring growth of communications is an engine that drives our developing information economy. New communications technologies, including advancements in electronic mail, wireless telephones, and the Internet, are essential to new methods of business, education, and entertainment. Our economy depends upon readily available and reliable communications systems for its most basic functions. This has several consequences. First, we must be careful not to stifle the growth of communications technologies through undue government action. Second, we must ensure that emerging communications technologies are as reliable and safe to use for business, education, and entertainment as the methods of communication we have used in the past and that are still in use. Third, we must take a technology-neutral approach, to the degree it is practical, when considering appropriate governmental action.

    Mr. Chairman and Members of the Subcommittee, thank you for allowing me this opportunity to testify about H.R. 5018, the "Electronic Communications Privacy Act of 2000," and H.R. 4987, the "Digital Privacy Act of 2000." Twice before this year I have had the privilege of testifying before you on issues relating to the protection of privacy and public safety in cyber-space, and I am pleased to be here today to continue that discussion. The Internet and Public Safety Over the last decade, use of computers and the Internet has grown exponentially, and individuals have increasingly come to depend on this use in their daily lives. The Internet has resulted in new and exciting ways for people to communicate, transfer information, engage in commerce, and expand their educational opportunities. These are but a few of the marvelous benefits of this rapidly changing technology. There is no question that the Internet has changed the way we live today. Yet, as has been the case with every major technological advance in our history, we are seeing individuals and groups use this technology to commit serious criminal acts. As people have increasingly used computers for lawful purposes, so too have criminals increasingly exploited computers to commit crimes and to harm the safety, security, and privacy of others.
