THURSDAY, JANUARY 13, 2000 Rams’ hysteria leads to ripoffs The Associated Press ST. LOUIS — A year ago, stores couldn’t give away Rams merchandise. Now, a replica blue and goal Kurt Warner No. 13 or Marshall Faulk No. 28 jersey is harder to find than home run king Mark McGwire’s No. 25. Problem is, licensed merchandisers aren’t the only ones taking advantage of the hysteria that came with an NFC-best 13-3 record. And as the Rams prepare to host Minnesota in this city’s first-ever NFL playoff game on Sunday, the NFL and local police will be on the lookout for counterfeit merchandise. NFL spokesman Brian McCarthy said Wednesday that four teams of NFL investigators will arrive in St. Louis Saturday to seek out those peddling counterfeit goods. One man, Ramanuel Kimble, 44, of Arlington, Texas, was indicted last month for selling fake Rams merchandise near the Trans World Dome. He faces felony charges. A trial date has not been set. Police and league officials believe others are doing it, too.

Sound small time? It's not. Together, the NBA, National Football League, National Hockey League, Major League Baseball and the licensing arm of the National Collegiate Athletic Association are spending millions of dollars each year to, in effect, fund a sports merchandise police force. Their objective: to protect their brand labels and to investigate and ensure the prosecution and conviction of those who illegally try to cash in on the multibillion-dollar sports apparel industry. The counterfeit shirts bought in Sacramento on Friday a transaction whose details are being kept secret by NBA officials were purchased by a member of an anti-counterfeiting group known as CAPS.

Boom in Holiday E-Commerce Brings Fear of Increased Consumer Fraud REDMOND, Wash., Nov. 15, 2000 This time of year, Santa is busy making his list and checking it twice. To keep up with the times, he's probably checking that list on a computer database and then cross-referencing his address list on the Internet. If so, Santa won't be the only one using the Internet this holiday season: the Gartner Group consulting firm estimates consumers will spend more than $19.5 billion in online shopping transactions this holiday season twice last year's total. However, the ease of Internet shopping and the anonymity of the Web combine to form a troubling specter of Holidays Yet To Come. A sizeable percentage of the commerce that will take place over the Internet this holiday season will involve counterfeit or fraudulent merchandise. The International Anti-Counterfeiting Coalition (IACC) estimates that trademark infringement and counterfeiting robs the United States of $200 billion annually. Internet shopping and auction sites have become a major venue for the dissemination of counterfeit goods. While the majority of Internet businesses are honest, the anonymity of the Web makes it easy for criminals to sell counterfeit and fraudulent materials.

Easter Sunday
Another walk uptown this afternoon after work. Today, I ventured off Broadway and cut, instead, through the heart of Soho and Greenwich Village including a brief roundabout through Washington Square Park. Perhaps the single most interesting part of the walk was midway up Wooster Street, strolling past all the galleries in Soho, when I suddenly realized it had grown startlingly quiet. No traffic roared down the narrow cobblestone street and the only other pedestrians wandering the sidewalks did so quietly and in their own personal rhythm. For that brief moment, there in the middle of Manhatten, the big city actually seemed quaint and peaceful. Which is exactly when I looked over my shoulder for the mugger sneaking up behind me. Of course, there was none. But a much worse crime is commited everyday in this bustling metropolis. A bit further downtown, along Canal Street, the sidewalks are lined with foreign-run carts and small shops, all crammed full with counterfeit merchandise. From Rolex watches to Fendi handbags to Mont Blanc pens, anything you desire can be purchased for a slim five dollar bill. It's a wild and crazy place, this big city. I'll be glad to be home for the weekend, nonetheless.

Francis Bacon, Advancement of Learning (1605), Bk I. For it was not that pure and immaculate Natural knowledge, by the light whereof Adam gave names unto the creatures, according to the propriety of their natures, which gave the first motion and occasion to the Fall; but it was that proud and imperative appetite of Moral knowledge, defining the laws and limits of Good and Evil, with an intent in man to revolt from God and to give laws unto himself, which was indeed the project of the primitive temptation. For, of the knowledges which contemplate the works of Nature, the holy philosopher hath said expressly, that the glory of God is to conceal a thing, but the glory of the king is to find it out

Robert T. Johnson
District Attorney
Bronx District Attorney Robert T. Johnson and New York City Police Commissioner Howard Safir announced today that an 10 month joint undercover investigation has resulted in the arrests of at least 17 major suppliers of counterfeit designer label clothing. Bronx District Attorney Johnson said: "These arrests represent pro-active law enforcement at its best and are the result of exemplary interagency cooperation and professionalism. Until we stepped in everybody was losing except the alleged thieves. The industry was losing tens of millions of dollars in revenue, the city and state were losing tax revenue and consumers were being defrauded. But now those who peddled this counterfeit merchandise, in order to pad their bank accounts, will be held accountable and punished." Commissioner Safir said: "Trademark infringement is a crime that has many victims, but at the end of the day it’s always the consumer who bears the brunt of the loss. This case demonstrates that whether you are trading counterfeit goods on the streets of Broadway or in the showrooms of Fifth Avenue, your crimes will be uncovered and you will be prosecuted to the full extent of the law." The law firm, Gursky & Ederer, P.C., which represents the vast majority of the designer labels that were victimized by the counterfeiters issued the following statement: "Our clients value their relationships with their customers and have spent years establishing an environment in which the customers have come to expect a high level of quality, style and performance from these brands. The sale of counterfeit merchandise can jeopardize these important relationships and harm the brand and the consumers. We believe the arrest and criminal prosecution of counterfeiters is the most effective deterrent."

July 16, 2001 Pirates Discover the Estonian "Nokia" by Virkko Lepassalu Over the past few years, Customs has confiscated tens of thousands of counterfeit or pirated items, but the question, what is to become of all these impounded goods, remains unanswered. Customs Board warehouses are almost at a bursting point because of all the seized goods being stored there. Presently, among the most commonly pirated industrial products, Nokia has taken the number one spot away from Christian Dior perfume. Customs Service specialist Ivar Kasema asserts that last year nearly 12,000 batteries, cellular phones, and other miscellaneous items bearing the Nokia trademark were determined to be counterfeit. These were manufactured in China, Hong Kong, and even in Great Britain. This year there have been about twenty incidents involving the confiscation of Nokia-brand products. Customs agents have already identified a total of 805 items as pirated goods, while thousands are still being processed. According to a report released Friday by the industrial intellectual property organization CIPR (Coalition for Intellectual Property Rights), damages caused by the pirating of intellectual property in the three Baltic states reach a total of 100 million dollars, or many billions of crowns a year. "If we look around in government agencies, we see that the bench seating intellectual property defenders is quite short," says the CIPR's Estonian representative Juri Estam, who nevertheless admits that progress is being made.

Auctionbytes-Update, Number 36 - April 22, 2001 - ISSN 1529-6703 Beware Designer Items! By Ina Steiner April 22, 2001 A reader wrote to me telling me that her auction was pulled from eBay, and wondered if I knew anything that might help her figure out why. What I discovered amazed me. The auction in question was a Chanel necklace. Our reader, Marina, bought the necklace from an estate sale. She listed the necklace on eBay, which then pulled the auction citing VERO. http://pages.ebay.com/help/community/vero-program.html Here's Chanel's explanation of its participation in eBay's VERO program from its AboutMe page http://members.ebay.com/aboutme/chanelusa "CHANEL has expended considerable resources to develop and maintain a reputation for providing the highest quality products and services to its customers. Through the auction of counterfeit merchandise, people attempt to trade off of CHANEL's well-earned reputation. These auctions not only cause monetary damage, but also damage CHANEL's reputation, as many of the purchasers of inferior counterfeit products will attribute the poor quality merchandise to Chanel. Having spent many years cultivating its strong reputation, CHANEL must take action to ensure that online auctions of counterfeit goods are ended, even by single-item sellers." I wrote to Chanel, and its lawyer contacted Marina and sent her an email: >>>> This message is written to you on behalf of Chanel, Inc. ("Chanel"). Chanel believes that the necklace you offered for sale on eBay is an infringing copy of a genuine Chanel necklace. If you wish, you may send your necklace to us at the following address for verification of authenticity:

COCA-COLA, NIKE, LOGO OWNERS SEE NEW THREAT FROM COUNTERFEITERS
Orlando, Florida, July 28 (Bloomberg) Coca-Cola Co., Nike Inc. and other corporate logo owners are joining together to combat what they say is the latest and most dangerous threat to their famous brands. Software programs are being sold over the Internet that can be used to instruct machines to etch onto glass or vinyl, or stitch onto clothing perfect copies of Coca-Cola's contour bottle, the Nike swoosh or Walt Disney Co.'s Mickey Mouse. The trademark owners have used letters, threats and the courts to try to protect their brands from bootleggers. The new software programs are potentially more devastating because they allow counterfeiters to distribute perfect copies of logos anywhere in the world. ``There's no doubt in my mind that these seedy logo cases are starting to crop up,'' said Frederick Mostert, author of ``Famous and Well-Known Marks'' and former president of the International Trademark Association. ``That's the fallout where technology is enormously beneficial to society, but there's also a price to pay.'' Logo Software
Hedrick gives his clients a choice they can either download logos directly from one of several Web sites, or buy a CD-ROM that can be delivered anywhere, according to his sites and the suit.
