EFF Media Release: Conviction of Scientology Critic Raises Free Speech Issue. San Francisco - The Electronic Frontier Foundation (EFF) today expressed concern over a California court conviction of H. Keith Henson in a case involving online criticism of the Church of Scientology (CoS). In a decision which appears to have violated his constitutional right to free speech, a jury in Riverside County convicted Henson of threatening the free exercise of religion by members of the CoS. (June 22, 2001)

A federal court in Berlin has failed to reach a verdict on the legal status of a scientology group. The federal administrative court referred the case back to a regional court. The ruling was expected to give guidance on whether the German government has legal justification for its clampdown on scientology. While the church is not officially banned in any European country, it continues to fight rulings over its tax-exempt status. Our Religious Affairs Reporter Jane Little examines the concern surrounding the church of Scientology.

U.S. Department of State, September 5, 2000 GERMANY The Basic Law (Constitution) provides for religious freedom, and the Government generally respects this right in practice. There was no change in the status of respect for religious freedom during the period covered by this report. Relations between the various religious communities are amicable. The Government does not recognize Scientology as a religion and views it as an economic enterprise. Concerns that Scientology's ideology is opposed to a democratic state have led to the screening of firms and individuals in some sectors of business and employment. The U.S. Government discusses religious freedom with the Government in the context of its overall dialog and policy of promoting human rights. The status of Scientology was the subject of many discussions. The U.S. Government has maintained consistently that the determination that any organization is religious is for the organization itself. The U.S. Government has expressed concerns over infringement of individual rights because of religious affiliation and over the potential for discrimination in international trade posed by the screening of foreign firms for possible affiliation with Scientology.

The many responses to Freedom magazine (published by the Church of Scientology) from local Clearwater residents show that our readers are interested in Clearwater and want to know more about it. Many residents expressed an interest in the colorful history of our city. Thus, Freedom magazine printed a multi-part series on the history of Clearwater, covering the discovery of what became known as Clear Water Harbor by early settlers through World War II. Because of the overwhelmingly popularity of that series, we are reprinting it in full on these web sites. The first settlers who came to Clear Water Harbor, as it later was known, found the climate gentle and refreshing, game plentiful in the woodlands and the scenery tranquil.
Gently purling from its harbor, a sulfated spring left the Gulf waters dazzling and translucent along the coastline. To fish off its shores, the first visitors to the area may have journeyed from the south, or sailed from nearby isles, or even wandered down from the northern land bridge which once spanned the continents. While no one quite knows from whence they came, the earliest settlers by Clear Water Harbor, as it came to be known, found the climate gentle and refreshing, game plentiful in the woodlands and the scenery tranquil. They were the Mound Builders, called that because they left great mounds of mollusk shells behind.

    Web posted at: 11:14 p.m. EST (0414 GMT) CLEARWATER, Florida (CNN) The Church of Scientology was charged by Florida prosecutors Friday in the death of a member. The State Attorney's office in Pinellas County filed the felony charges after a lengthy investigation into the 1995 death of Lisa McPherson. McPherson had been a member of the church for 18 years and, according to relatives, had been talking about leaving the church. McPherson, 36, died December 5, 1995, after being confined for 18 days to a Scientology property called the Fort Harrison Hotel, investigators said. Prosecutor Bernie McCabe charged the church with abuse or neglect of a disabled adult and unauthorized practice of medicine, both felonies.

    Google was accused Wednesday of effectively removing from the Internet a Web site that is critical of the Church of Scientology after it deleted links to some of the site's pages from its search engine. Xenu.net , said in a Usenet posting that the complaint demanded that Google take down a large number of references to different parts of Xenu.net. "The complaint mentions a ridiculous list of addresses, which successfully removes the whole site from their engine," he said. Digital rights advocates said the Church of Scientology's takedown request is noteworthy because it underscores potential conflicts between the DMCA and free speech. A representative for the Church of Scientology could not be immediately reached for comment. The right to link has been the subject of several high-profile lawsuits, including a dispute between hacker publication 2600.com and the motion picture industry over code known as DeCSS that can theoretically be used to crack DVDs. In that case, a federal judge in New York held that links to the DeCSS code violated the anti-circumvention clause of the DMCA, which bars trafficking in software that can be used to defeat copy protection. Well, you might be relieved to know that SOMETHING CAN When Lorraine Baritz of Boston was called to the hospital by friends whose 13-year-old son was in a coma and on life-support four days after a severe motorcycle accident, she knew exactly what she had to do to help. News of the recovery traveled through the hospital, reaching others standing vigil by their own children. A couple with an infant son in a coma asked for help. Again Lorraine answered the call. The outcome was reported in the local Boston newspaper: Stories like these are commonplace, anything but common in a world where people are searching for answers on how to provide real and lasting help to others.
