B EIJING, Jan 13 China, which executes more people than the rest of the world put together, has held its first public discussion of the death penalty, where legal experts called for the abolition of the capital punishment. While scholars in China have debated the pros and cons of the death penalty for more than 200 years, these days the battle of opinions has evolved into a debate on how to limit the use of capital punishment and gradually phase it out. "Strict limitation of death sentences and their gradual abolishment is the mainstream view in China these days," said the Guangzhou-based Southern Weekend newspaper, which carried the first report of the conference held last month in Xiangtan, Hunan province.

Widespread support for death penalty
Public support for the death penalty is reinforced by the large number of mainly elderly farmers being murdered on their farms. Over the past few years an average of two to three farmers are murdered every week; some with vicious brutality. The recent upsurge of cases, where infants who are only a few months old are raped, has filled newspaper letters pages with demands for a return of the gallows.
Effectiveness of deterrence
There is a popular assumption that the harsh punishment of criminals serves as a deterrent to crime and thereby ultimately reduces crime. There is, however, little undisputed scientific evidence to demonstrate a correlation between harsh punishment and levels of crime.
According to the 1997 national Victims of Crime Survey, 60% of assault victims and 63% of sexual offence victims knew the offender by name, while a further 17% of assault victims and 12% of victims of a sexual offence knew the offender by sight. Fewer than a quarter of assault and sexual offence victims did not know the offender at all.
It would appear that the majority of murders, rapes and assaults in South Africa (as in most countries) are not committed by calculating individuals who plan their crimes and weigh up the pros and cons of committing them. Rather, most of these crimes are committed in a moment of passion, anger, thoughtlessness, spite or drunkenness. The fear of being punished harshly if they are caught and convicted for their deeds, does little to prevent the criminal actions of such offenders.

JUVENILES VS THE DEATH PENALTY Capital punishment has always been a controversial topic, that could be debated until the end of time. However, a new topic has taken centerstage in the legal world that has everyone focused on the Supreme Court. The topic weather it is appropriate for the death penalty to be imposed on juvenile offenders is now debated in courtrooms all over the nation. "Although the American public is generally in favor of the death penalty, surveys indicate that a substantial majority oppose capital punishment for minors." Only 24 of the 50 states now allow the execution of juveniles, and nationwide there are 28 juvenile killers on death row. The reasoning behind both arguments (for and against) are solid facts and ideas that leave you deliberating the pros and cons of capital punishment. Obviously, there is no clear winner in this debate and it is still weighing in the minds of not only the public but the courts as well. Personally I feel that the death penalty is a hard decision that faces not only our government but also our society. While as a society we cry out for justice when one of us has been wronged, I'm not sure if revenge by death is an acceptable solution. We as a county make it illegal to kill someone but yet we reserve the right to impose death if we feel the crime is vicious? I feel the death penalty is morally wrong in any circumstances. I do not think that it deters crime or instills fear in the criminal. I think that juveniles can be responsible for their actions and crime with out having to give their life. I believe that juveniles can be rehabilitated and that society should not give up so easily.They should be given the chance to redeem themselves and to turn around their life, and with the right support i believe that they can learn from the experience and move on to be productive part of society.
