1991 No. 8 December Table of contents Lawyers in Business Conflicts Principles Approved After studies, debates, drafts and re-drafts that stretch back almost 20 years, the Benchers have now approved seven principles that will lead to a new business conflicts ruling in the Professional Conduct Handbook Law Society committees studying business conflicts over the past decade have recognized that a lawyer may act as a legal advisor or a business partner, but not both. Yet translating this concept into specific principles and rulings has proved difficult. A special committee chaired by William Ireland, Q.C. of Vancouver prepared a preliminary draft ruling on conflicts arising out of lawyers' business relationships with clients in 1985. This was reviewed and sent back for revision by the Benchers. The re-draft was circulated to members for comment in early 1987, [February, 1987 Benchers' Bulletin ]. Some lawyers at the Annual Meeting that year criticized the proposed rulings as too broad and almost enforceable, especially in smaller communities where some of the provisions were contrary to accepted practice. The ruling was also criticized for extending to lawyers' affiliates and associates. The pivotal business conflicts ruling B/9(b) of the Professional Conduct Handbook now states that "[n]o member shall act for a client where there is a possibility, no matter how remote, that his duty to his client conflicts with his personal interests." Other aspects are covered by Canons 3(2) and 3(7), and by Rulings B/8 (engaging in other business), B/13 (borrowing and investing), and B/14 (finders fees).

First, the Computer Abuse Act, Title 18 of the criminal code, section 1030 specifically, renders computer trespass (not the scan "rattling of doorknobs" but penetration, retrieval and/or damage) and destructive programs (worms, viruses, etc.) illegal. Second, the Electronic Communications Privacy Act (ECPA) establishes privacy of electronic communications at a standard similar to the wiretapping act of the late sixties. In short, the disclosure of any information by an Internet Service Provider to the public is actionable. Since Congress amended ECPA in 1994 to include wireless communications, "sniffing" (1) "Sniffing" is a slang term for interception of data communications. In telephonic communcations the analogous term is "tapping." I decided to contact the student, not as an employee of the university but as a regular person on my home computer and with my private e-mail address. I asked him to redact my name and that of another employee. He never did; it remains up today as I write. Now, if this is the worst incident to occur in my life I shall lead a charmed one indeed. Given its minor significance I present it as an example of an ethical question. Meet our instructors: Gary Kercher is a welcome addition to our staff. He is a graduate of the Ohio Peace Officers Training Academy and an active duty police officer. Allan Hess is currently the Executive Director of the Clark County Agricultural Society and manages the Clark County Fairgrounds. He has had an interest in the shooting and hunting sports since early childhood. In passing along his passion for the shooting sports he just completed the hunter education course with his youngest daughter who has been shooting with him for several years now. Allan took the certified instructor's training program offered by the NRA to be able to teach others how to safely handle, use, enjoy, and store their firearms. He is NRA certified to teach Home Firearm Safety, Basic Pistol, Personal Protection In the Home. Allan is our mainstay when it comes to organizing our classroom instruction. AshleyHowell is currently working as a security specialist. He is a life member of the NRA and a member of the Peoples Rights Organization. Ashley is a breath of fresh air to our group. He enjoys reloading his own ammunition and is currently studying to become an NRA certified reloading instructor. Ashley is NRA certified to teach Home Firearm Safety, Basic Pistol, and Personal Protection In the Home. Jim Stouffer Dick Martin is our lead instructor and takes care of our finances. He is a stickler for detail. He is the type of instructor who can take an 8 hour course and turn it into 14 hrs. real easy! He is currently employed as a logistics management specialist in federal civil service at Wright-Patterson Air Force Base. He lives in Fairborn, Ohio with his wife, Cindy. In 1949, when Dick was eight years old, his father, a career soldier in the U. S. Army, started teaching young Dick to safely handle and shoot firearms, starting with a BB pistol. Dick got his first "real gun", a Remington bolt-action .22 rifle, at age.10. He is still an active shooter. Dick is certified by the National Rifle Association (NRA) as an instructor in Home Firearms Safety, Basic Pistol and Personal Protection in the Home. Dick is also an NRA Certified Range Safety Officer. He has been teaching NRA courses since June, 2000.
