Actions on 2002 Proposals

Details from proposed boating regulations provided to the public for comment. Often Maryland residents think they can do little to affect the boating activity in their area. However, the Maryland Department of Natural Resources works with the public daily to provide safety on the waterways of the State. Problems with speeding, overcrowding, and congestion can be addressed in a number of ways. In areas where problems are consistent and the problems pose significant safety issues, regulations creating speed zones may be necessary. The Regulatory Process
Creating a speed zone is a regulatory process. The process starts by submitting to the Maryland Boat Act Advisory Committee, a petition signed by at least 25 people detailing where, why and what type of restriction is requested. The Department then begins researching and investigating the area. Buoys are placed in the area advising boaters that the area is under study. Notices to boaters concerning the proposed regulatory change are distributed in the area. During the next boating season, a vessel traffic survey is conducted by the Department. This information includes the types and amount of vessels in the area as well as their activity levels, speed and operating hours. In addition to these surveys, any reports the Department has on file concerning vessel use, accidents, complaints, and boating violations are compiled. Public comment is solicited from boaters and property owners in the area. When the study period ends, all the accumulated data is compiled . At that time, a public meeting may be held to solicit additional public input. The Department then submits an Executive Summary to the State's Boating Law Administrator. The Boating Law Administrator presents this recommendation to the Maryland Boat Act Advisory Committee.

Information in this digest may change due to Legislative, Commission or USCG action. TEXAS REGISTRATION AND TITLE All motorboats and all sailboats 14 feet in length or longer operated on public waters or docked, moored, or stored on public water must be currently registered, properly displaying authorized numbers and validation decal, and titled. All outboard motors must be titled. Title applications and manufacturers statement of origin (MSO) must accompany a request for boat registration for new boats and outboard motors.
Exempted vessels All canoes, kayaks, punts, rowboats or rubber rafts (regardless of length) when paddled, poled, or oared and sailboats under 14 feet in length when windblown. TEXAS CERTIFICATE OF NUMBER When a vessel which is required to be registered is in operation, the certificate of number (registration) must always be aboard and available for inspection by an enforcement officer. The certificate is valid for the two-year period shown on the certificate. When a certificate is renewed the same number shall be reissued, if application to the Department is made within the 90 day period preceding the expiration date. HOMEMADE BOATS Requires affidavit of the person as to the origin of the boat, proof of the materials used in the construction of the boat (i.e., bills from marine and hardware dealers for parts, etc.), and requires each homemade boat to be inspected and certified by a Texas Parks and Wildlife (TPW) game warden. Inspection fee - $25.00.

Please note that this is not a complete set of boating laws. This is the information published in the Wisconsin Department of Natural Resources Boating Regulations pamphlet. You may obtain further information by E-Mail or by contacting your local conservation warden or law enforcement authorities. Wisconsin boaters enjoy one of the finest recreational boating safety programs in the nation. To aid those in distress on our waters and to assure that the requirements of law are obeyed Wisconsin Conservation Wardens, many county sheriff's departments, municipal police departments and the U.S. Coast Guard have established marine enforcement patrols. Whenever your boat is approached by an authorized patrol boat displaying blue lights you shall reduce the boat speed to slow-no-wake speed and yield the right-of-way to the patrol boat. The operator of a boat shall stop when requested to by a law enforcement officer or patrol boat. These officers are charged with the responsibility of providing safety afloat. Probably the best option for the average boater, classroom courses are typically held for several hours a night, one night a week for six or more weeks. Some classes are held in a "short-course" format on one day, and some are four-hour courses that require pre-study. Classes offer students the chance to interact with an experienced boater and learn in a fun, relaxed atmosphere. Upon completion of the class, the instructor will test the students and provide a Boater Education Card application if the student passes. USPS = United States Power Squadrons. Two courses are offered for all boaters, including personal watercraft riders, hunters and anglers, who operate powered watercraft and sailboats. Information covered includes nautical rules, regulations, and courtesies on the water. The only cost for these courses is for materials, including the certificate of completion for those passing the final examination. This certificate qualifies you for your Marine Board issued Boater Education Card.

    Various Federal, State, and local regulations apply to Mission Bay and the ocean off the City of San Diego. Some of the major regulations are listed below.
    • General Vessel Speed
      No person may operate a vessel at a speed greater than five (5) miles per hour within 100 feet of a swimmer or surfer or within 200 feet of a beach frequented by swimmers.
      Ocean Vessel Speed
      No person may operate a vessel in excess of five (5) miles per hour within 1,000 feet of the oceanfront coastline of the City of San Diego. Separate boating regulations apply to Mission Bay.
      Mission Bay Vessel Speed
      The speed limit on Mission Bay from sunset to sunrise is five (5) miles per hour. At other times, certain areas have a designated speed limit of five (5) miles per hour or less. These include:
      Wherever buoys are posted with a five (5) mile per hour limit Near bridges Within 100 feet of shore Within 100 feet of another vessel Minimum Age
      No person under the age of twelve (12) may operate a motorized vessel with more than fifteen (15) horsepower. Children ages twelve (12) to sixteen (16) must have a person eighteen (18) years of age or older onboard to operate such a vessel. (There are some limited exceptions.)

    Boating Enforcement Go to: Boating Registration A Federal Regulation went into effect May 1, 1995, which requires operators of all boats to have at least one wearable life jacket or personal flotation device, for each person aboard. Under the new regulation a throwable PFD (Type IV) will no longer qualify as a life jacket on boats less than 16 feet. PFD requirements remain unchanged on boats 16 feet and over.
    Section 59-21-31 of the Mississippi Code, prohibits the removal or alteration of awarded numbers or identification numbers affixed to vessels, boats, outboard motors and trailers has been amended. Additional language added to this section provides that no person may buy, sell or possess a vessel, boat, outboard motor or trailer on which any awarded number or identification number has been removed or altered.
    Due to the increase in marine theft, a closer look is being taken at applications for boat registration when received. Applications for boat registration with required information missing or information which appears to be incorrect, will be sent back to the applicant along with a boat inspection form to be completed by a conservation officer. The application should then be resubmitted along with the completed boat inspection form. All home-made boats will be inspected prior to registration.

    Boaters must observe the following federal requirements in addition to Idaho's Boating Laws while on Idaho waters that are also on the Coast Guard's list of federally navigable (or federally controlled) waters (see chart below). 1) Safety equipment: In Idaho, visual distress signals are not required unless you are on federally controlled waters. Boats used on federally controlled waters must have U.S. Coast Guard-approved day and night visual distress signals.     REGULATIONS - Florida Boating This section contains information on Florida Boating Regulations that are in addition to the Federal Requirements covered in the Basic Boating Course . If you have not reviewed the course material, please do so now. All Federal Requirements in the basic boating course apply to Florida; this section lists Florida Boating Requirements that are above and beyond Federal Requirements. The Nautical Know How Boating Safety ID card is recognized in the State of Florida as proof of successful completion of a Boating Safety Course. If you are covered by Florida's mandatory boater education law, you will also receive an ID card from the state of Florida. Florida and federal boating laws are presented in a summarized form.     SAFETY - Health and Fitness Scuba diving is an activity that anyone with good health and fitness can enjoy for a lifetime. No upper age limit for participation in scuba diving exists, provided a diver is healthy and fit and has no disqualifying medical conditions. Some divers may be asked by their physician to perform an exercise tolerance test to rule out any cardiovascular (heart) problems - this is appropriate when the diver is older or appears generally out of shape. This test allows a physician to collect information about how well an individual responds to exercise. To get the most out of your lifetime of diving, practice disease and injury prevention and participate in a health maintenance program:
    • See your physician for regular checkups
    • Participate in a regular exercise program
    • Be rested and well-nourished before diving
    • Use proper exposure protection and equipment
    • Plan your dive to avoid overexertion
    Most of all, don't hide or downplay any medical condition or health problem. It's better to have an open and frank discussion before a problem arises than to wonder if the injury could have been avoided. Finally, if you have questions on your own diving fitness, queries about certain medical conditions when diving, how to find a diving doctor in your area, or if your physician has any questions, call DAN's Dive Safety and Medical Information Line at (919) 684-2948 from 9 a.m. to 5 p.m. ET.
