    Holmes, Oliver Wendell, 1841-1935 1841-1935, American jurist, Associate Justice of the U.S. Supreme Court (1902-32), b. Boston; son of the writer Oliver Wendell Holmes. He served (1861-64) with distinction in the Civil War, took a law degree at Harvard (1866), and began practice in Boston in 1867. Holmes taught (1870-73) constitutional law and jurisprudence at Harvard while editing the American Law Review and the 12th edition (1873) of Kent's Commentaries. The Common Law Speeches (1891, 1913), and Collected Legal Papers See S. J. Konefsky, The Legacy of Holmes and Brandeis (1956, repr. 1974); Felix Frankfurter, Mr. Justice Holmes and the Supreme Court (2d ed. 1961); biographies by M. D.   • Democritus of Abdera, commonly known as the Laughing Philosopher, probably because he did not consider the study of truth inconsistent with a cheerful countenance, believed and taught that all bodies were continually throwing off certain images like themselves, which subtle emanations, striking on our bodily organs, gave rise to our sensations. Epicurus borrowed the idea from him, and incorporated it into the famous system, of which Lucretius has given us the most popular version. Those who are curious on the matter will find the poet's description at the beginning of his fourth book. Forms, effigies, membranes, or films are the nearest representatives of the terms applied to these effluences. They are perpetually shed from the surfaces of solids, as bark is shed by trees. Cortex is indeed, one of the names applied to them by Lucretius.
  • These evanescent films may be seen in one of their aspects in any clear, calm sheet of water, in a mirror, in the eye of an animal by one who looks at it in front, but better still by the consciousness behind the eye in the ordinary act of vision. They must be packed like the leaves of a closed book; for suppose a mirror to give an image of an object a mile off, it will give one at every point less than a mile, though this were subdivided into a million parts. Yet the images will not be the same; for the one taken a mile off will be very small, at half a mile as large again, at a hundred feet fifty times as large, and so on, as long as the mirror can contain the image.

    Oliver Wendell Holmes Jr. was named after his father who was a poet, essayist, novelist, and professor of anatomy. Young Holmes received his undergraduate education at Harvard, graduating as class poet in 1861. He served as an officer in the Massachusetts Twentieth Volunteers during the Civil War, and then returned to Harvard to study law. He was a practicing attorney in Boston for 15 years while teaching law at his alma mater. In 1881, a series of lectures prepared by Holmes was published in a volume titled The Common Law. In 1882, Holmes was appointed to the Massachusetts Supreme Court. He remained on the state Court for 20 years, serving the last three as chief justice. In 1902, President Theodore Roosevelt nominated him for the Supreme Court of the United States. After 29 years of service on the bench, Justice Holmes retired at the age of 90, making him the oldest justice to have served on the Supreme Court of the United States.

G. Edward White first sketches Holmes's early years-his childhood in Boston, undergraduate years at Harvard, and his valiant service in the Civil War, during which he was severely wounded three times. After the war, Holmes went into private law practice, wrote his landmark treatise The Common Law in 1881, had a short tenure on the Harvard Law School faculty, and spent 20 years as a judge on the Supreme Judicial Court of Massachusetts before being named to the U.S. Supreme Court. The author focuses on his remarkable 30-year service as a Supreme Court Justice, beginning in 1902, and details Holmes's most significant cases Abrams v.

However, the Holmes family was of the same general group of Puritans in Mass. as the Ways and others of the Midway group Justice Holmes' grandfather Rev. Abiel Holmes was pastor of Midway Congregational Church from 1785 to 1791; then he was pastor in Cambridge, Mass., for 40 years. That latter period, 1791-1831, overlapped with the period, 1823-1849, that Rev. Robert Quarterman was pastor at Midway. Hm, that leads to an interesting question. I wonder if the Cambridge church preserved any correspondence between them? The Holmes family, which mostly resided in Woodstock Connecticut, is also part of the Connecticut connection. As late as the Justice's father's generation there was active communication between the Midway people and some descendants of the other branch of the Dorchester Mass. church that had moved to Windsor, Conn.

    My father was very familiar with the sailing ship, Old Ironsides , and we went to see it when he visited me when I was living in Boston. The timber for that ship came from Liberty County, Georgia, and of course it was Abiel's son and Justice Holmes' father the doctor who wrote the famous poem ``Old Ironsides'' which helped organize the preservation of the ship.

    To be seventy years young is sometimes far more cheerful and hopeful than to be forty years old. Put not your trust in money, but put your money in trust. The morning cup of coffee has an exhilaration about it which the cheering influence of the afternoon or evening cup of tea cannot be expected to reproduce. Nothing is so common-place as to wish to be remarkable. Why can't somebody give us a list of things that everybody thinks and nobody says, and another list of things that everybody says and nobody thinks. Nature, when she invented, manufactured, and patented her authors, contrived to make critics out of the chips that were left. What I call a good patient is one who, having found a good physician, sticks to him till he dies. What a comfort a dull but kindly person is, to be sure, at times! A ground-glass shade over a gas-lamp does not bring more solace to our dazzled eyes than such a one to our minds. All generous minds have a horror of what are commonly called "facts." They are the brute beasts of the intellectual domain. Who does not know fellows that always have an ill-conditioned fact or two that they lead after them into decent company like so many bull-dogs, ready to let them slip at every ingenious suggestion, or convenient generalization, or pleasant fancy? I allow no "facts" at this table.

    This essay were presented as two lectures to the Boston Society for the Diffusion of Useful Knowledge in 1842 and was reproduced in Examining Holistic Medicine (Prometheus Books, 1985). The author achieved prominence as a physician, poet, and humorist. His son, Oliver Wendell Holmes, Jr., became a justice of the U.S. Supreme Court. It is necessary, for the sake of those to whom the whole subject may be new, to give in the smallest possible compass the substance of the Homeopathic Doctrine. Samuel Hahnemann, its founder, is a German physician, now living in Paris, at the age of eighty-seven years. In 1796 he published the first paper containing his peculiar notions; in 1805 his first work on the subject; in 1810 his somewhat famous "Organon of the Healing Art;" the next year what he called the "Pure Materia Medica;" and in 1828 his last work, the "Treatise on Chronic Diseases." He has therefore been writing at intervals on his favorite subject for nearly half a century. [Hahnemann died in 1843.] The one great doctrine which constitutes the basis of Homeopathy as a system is expressed by the Latin aphorism

    Gallery of Images At once a well-known and easily mistaken identity, this name has meaning for the literary, legal, and medical communities the world over. This page is offered as a starting point for those who would like to know more of the Oliver Wendell Holmeses, the family, and their works. A brief introduction will be useful. Let's start from a point just about two hundred years ago, with a minister of religion (who was also an author ) named Abiel Holmes (1763-1837). His second wife, Sarah Wendell, and he had five children: Mary, Ann, Sarah, Oliver and John. This first Oliver Wendell Holmes (1809-1894), doubtless somewhat influenced by family precedent, became a physician. He also became a writer , and was much in demand as a speaker. Doctor Oliver Wendell Holmes married Amelia Lee Jackson when he was thirty. They had three children: Oliver Wendell, Jr. (1841-1935), Amelia Jackson Holmes, and Edward Jackson Holmes. In 1875, Dr. Holmes was chosen to be the first President of the Boston Medical Library, remaining such until 1888 when he resigned primarily to meet his growing literary commitments. In the following year, Dr. Holmes gave nearly one thousand medical books to the Boston Medical Library, together with the shelving necessary to make them available to readers. His devotion was shared by his daughter, Mrs. Turner Sargent. She continued his generosity the next year with a bequest of a handsome sum of money to be paid over after the deaths of both the doctor and her brother, who was a judge. Dr. Holmes and his wife are interred in Cambridge at Mount Auburn Cemetery, where their monument can be
