London, 1 February, 1821. 12mo, one page; 15 lines, in ink, in Bentham's hand, with a further inscription docketed on the verso by Place: 'Aimé - just now says Evan Law another brother of Lord Ellenborough lives in Sussex - and is a very singular fellow F. P.'; one fold, minor soiling to corners; offered with the letter is a contemporary paper slip, 'in an unknown hand' (Correspondence X, 274n), stating 'In answer to inquiries I caused Place to address to him [i.e. Bentham] respecting Thomas Law, who I suspected at that time to have been the author of the "Spirit of Despotism" (written by Dr V. Knox)'. The letter reads:

I know of no Evan Law, brother to Lord Ellenborough. A[nn]o 1792 or 1793 there was a brother of Ld. E. hot from the E. Indies who had two passions, the object of the one of them the Mocurrery system, of the other the Defence of Usury, in pursuit of which latter he made up to me and was received. But my memory greatly deceives me, if his name was - not Evan, but ' Tom '. He went to America and speculated largely in building at Washington. I should not have expected to find him the author of such a book.

Edited by Louis Crompton (First published in the 1978 summer and fall issues of Journal of Homosexuality, Editor's Abstract: This is the first publication of Jeremy Bentham's essay on "Paederasty," written about 1785. The essay which runs to over 60 manuscript pages, is the first known argument for homosexual law reform in England. Bentham advocates the decriminalization of' sodomy, which in his day was punished by hanging. He argues that homosexual acts do not "weaken" men, or threaten population or marriage, and documents their prevalence in ancient Greece and Rome. Bentham opposes punishment on utilitarian grounds and attacks ascetic sexual morality. In the preceding article (Journal of Homosexuality, 3(4), 1978, p. 383-387) the editor's introduction discussed the essay in the light of 18th-century legal opinion and quoted Bentham's manuscript notes that reveal his anxieties about expressing his views. The Bentham texts were drawn from the 1776 1st edition A Fragment on Government , and from the 1823 2d edition Introduction to the Principles of Morals and Legislation . We have also included (from Bowring) the "Historical Preface, intended for the Second Edition," of A Fragment on Government
In this edition of the Principles , we have silently included corrections made either by Bowring or by the 1907 Clarendon edition, which were based on a 1789 sheet of corrections, overlooked in a number of instances in the 1823 edition.
In the Principles , Bentham's section numbers are not used in the reference lines. Rather, each paragraph is identified by its numerical heading (given in Arabic in both the reference lines and in the body of the text), and paragraph number where appropriate. Only a few of Bentham's chapters were divided into sections; the use of the numerical headings is more specific in any event. These numerical headings are identified in the reference lines as "Sec." consistent with other of our databases.

Jeremy Bentham ( bis nach Christus)
Größtmögliches Glück für die größtmögliche Zahl. Bentham wurde am 15. Februar in London geboren, studierte Jura und wurde Anwalt. Die politischen und sozialen Mißstände seiner Zeit infolge des starren Systems von Adelsprivilegien machten aus ihm einen Kämpfer für allgemeine Reformen. Beeinflußt von der Aufklärung die zwar ganz Europa geistig befruchtet, in der Praxis jedoch noch keine Auswirkungen gehabt hatte, griff er die englische Verfassung an und wurde so zum Protagonisten des englischen philosophischen Radikalismus. Wirtschaftspolitisch liberal im Sinne von Adam Smith, trat er ebenso wie der Schotte für Eigeninitaiative und ein möglichst geringes Eingreifen des Staates in die Wirtschaft ein. Sein politisches Prinzip der Nützlichkeit (Utilitarismus) erstrebt, völlig im Gegensatz zur bisherigen Gesellschaftsordnung, "größtmögliches Glück für die größtmögliche Zahl".

HUTCHINSON ENCYCLOPEDIA Bentham, Jeremy English philosopher, legal and social reformer, and founder of utilitarianism . The essence of his moral philosophy is found in the pronouncement of his Principles of Morals and Legislation (written in 1780, published in 1789) that the object of all legislation should be the greatest happiness for the greatest number. Bentham declared that the utility of any law is to be measured by the extent to which it promotes the pleasure, good, and happiness of the people concerned. In 1776 he published Fragments on Government . He made suggestions for the reform of the poor law in 1798, which formed the basis of the reforms enacted in 1834, and in his Catechism of Parliamentary Reform , published in 1817, he proposed annual elections, the secret ballot, and universal male suffrage. He was also a pioneer of prison reform.

Disappointed, after his return to England in 1788, in the hope of making a political career, he settled down to discovering the principles of legislation. The great work on which he had been engaged for many years, An Introduction to the Principles of Morals and Legislation, was published in 1789. In this book he defined the principle of utility as that property in any object whereby it tends to produce pleasure, good or happiness, or to prevent the happening of mischief, pain, evil or unhappiness to the party whose interest is considered. Mankind, he said, was governed by two sovereign motives, pain and pleasure; and the principle of utility recognized this state of affairs. The object of all legislation must be the greatest happiness of the greatest number. He deduced from the principle of utility that, since all punishment involves pain and is therefore evil, it ought only to be used so far as it promises to exclude some greater evil.
In 1823 he helped to found the Westminster Review to spread the principles of philosophic radicalism. Bentham had been brought up a Tory, but the influence of the political theory of the Enlightenment served to make a democrat of him. As far back as 1809 he had written a tract, A Catechism of Parliamentary Reform, advocating annual elections, equal electoral districts, a wide suffrage, and the secret ballot, which was, however, not published until 1817. He drafted a series of resolutions based on this tract that were introduced in the House of Commons in 1818. A volume of his Constitutional Code, which he did not live to complete, was published in 1830.

Stephen Jay Gould in the August 92 issue of Natural History uses the (Francis) Bacon Paradox: The old age of the world . . . is the attribute of our own times, not of that earlier age in which the ancient lived; and which, though in respect of us it was the elder, yet in respect of the world it was the younger. Now how gripping and significant is a paradox that arises from conventions in the usage of English? Does it even qualify? For all that it takes for resolution is to say exactly what is meant, rather than the contracted idiomatic form. An ancient species is one that existed relatively speaking a long time ago; the meaning is clear. A recent species has come into existence in recent times.
