Hayton & Marshall Law of Trusts & Equitable Remedies
There are about a dozen standard student textbooks in England relating to the law of trusts and equitable remedies. This book - Commentary and Cases on The Law of Trusts and Equitable Remedies by Hayton (& Marshall) is one of the best. I recently had reason to look at it for some research I was doing on the equitable remedy of rectification and found it very good (by the standards of a student textbook) in comparison with some other English student textbooks I looked at. For a practitioner standard English law work on equitable remedies Snell's Equity is better (but it is also much more expensive). However, for law students Hayton is a good course book. It is quite traditional in that the treatment of the law is relatively detailed. For teachers who want students to think about equity in terms of concepts, what is justice? what is the role of equity in the twenty-first century? and all that good stuff, then this may not be the book they need. On the other hand, for teachers who want a book that students can use to learn the law in this area of English law, it is likely to be helpful.
This is one of those textbooks that sets out extracts of many judgments and relevant legislation. This may make it attractive to people that do not have access to an English law library.
