In addition, the department assists the Court in sentencing through the completion of pre-sentence investigations on offenders as directed. Special services and intensive supervision are provided to those offenders, who have a history of substance use and abuse, and to those where mental health disorders or mental retardation are evident. In 1996, Restorative Justice was introduced as an innovative, philosophical approach to supervision. This new paradigm, stressing the development of competencies and accountability within clients, has led to the introduction of new, educational programming for those under the department's supervision. Included in these on-site classroom presentations are Adult Literacy, Alcohol Highway Safety, Finance Health Issues, Job Readiness Training, Retail Theft Rehabilitation, and Substance Abuse Education. Other services offered by the department include the Community Work Service Project, Electronic Monitoring, and the Restitution Enhancement Program. In a continuing effort to upgrade and enhance departmental programming, several new initiatives are being developed, to include Victim/Offender Mediation, Child Abuse Prevention, and Domestic Violence Prevention.

Extractions: Return to the main page Previous document Next document 08-415 Corrections Services - Adult Probation and Parole The mission of Adult Probation and Parole (organizationally expressed as the Division of Probation and Parole) is to protect public safety by providing for the investigation and supervision of adjudicated adult offenders through the enforcement of legal statutes and the provision of community-based programs that are designed to facilitate offenders' adjustment and reintegration into society. The goals of the Division of Probation and Parole are: Ensure public safety and confidence in community sanctions. Manage the Division of Probation and Parole programs effectively, efficiently, and professionally. The Division of Probation and Parole functions as a "community services" division and consists of a headquarters office in Baton Rouge and 20 district offices strategically located throughout the state. The division protects public safety by investigating adjudicated adult offenders for the courts and other decision makers; supervising those who are placed on probation, parole (regular and good time), or work release; and enforcing the conditions attached to their presence in the community. As of July 14, 1998, there were 52,356 offenders under the supervision of the Division of Probation and Parole. Of these, 32,461 were on probation and 19,895 were on parole. Forty percent (40%) of the total offenders under supervision had been sentenced for drug-related offenses. In 1992 the Division of Probation and Parole assumed responsibility for monitoring community rehabilitation center contracts as well as inmates assigned to those contract work release facilities. These facilities are nonsecure, community-based residential facilities that have generally been utilized as a reintegration resource. They also provide an alternative to incarceration for parole technical violators. Of the seven work release facilities monitored by the Probation and Parole Division, three are contracted to private providers and four are operated through a cooperative endeavor agreement with the local sheriff's office.

Extractions: As we ("we" being PERS, the AG's office, our attorney Greg Hartman and AFSCME, along with OPEU and FOPPO) began looking into the needed corrections, we found not only a myriad of conflicting suggestions and countermanding directives, but also supportive legal decisions. What escaped all of these folks at the time of the original bills was the need to amend the Oregon Revised Statutes - i.e., the PERS law and definitions. By this time, the deadlines for filing new bills had long passed. Our only choice was to "gut-and-stuff" an existing bill that had a similar issue. HB 3406 was an unrelated bill with no relationship other than to provide a "vehicle" in which to make the drastic changes needed. State Rep. Richard Devlin (D-Tualatin) met with OPEU's Rich Peppers and myself to discuss the fact that we were going to virtually "kill" his existing bill and amend it to correct this problem. He graciously agreed to allow us to use his bill for this purpose. In fact, after consultation with Hartman he had amendments drafted to accomplish our goals.

Section 2. The amendments to ORS 238.005 by section 1 of this 2001 Act apply to all service by an adult parole and probation officer that is performed on and after the date that the adult parole and probation officer is classified for the purposes of ORS chapter 238 by the county governing body or other public body with authority to make that classification, whether that classification occurs before, on or after the effective date of this 2001 Act.
