Until this change in the law the Police were powerless to act unless the target was actually physically attacked. Since then almost every state in the USA has passed legislation making stalking a criminal offense. Old habits die hard however, and many contemporary stalking victims in America are still told that nothing can be done unless a physical assault takes place. The California laws against stalking passed in 1990 did not specifically address online stalking. Nevertheless it is useful to review them in relation to the Internet as a starting point for any discussion of cyberstalking and the law. The California Penal Code [ Section 646.9. Stalking. 1990 (Amended 1994) ] defines the crime of stalking as follows: Any person who willfully, maliciously, and repeatedly follows or harasses another person and who makes a credible threat with the intent to place that person in reasonable fear for his or her safety... is guilty of the crime of stalking

October 1998 CJ Letter - Back Issues Legislatures in Florida, Iowa, Missouri and South Carolina passed laws in 1998 providing for involuntary civil commitment of violent sex offenders following their criminal sentence. The U.S. Supreme Court paved the way for states in the 1997 Kansas vs. Hendricks ruling that upheld that states Sexually Violent Predator Act. Thirteen states now have such "sexual predator" laws, including Arizona, California, Illinois, Kansas, Minnesota, North Dakota, New Jersey, Washington and Wisconsin. The new Florida law passed as House Bill 3327 commits sexually dangerous individuals to the Department of Children and Family Services and also requires that those committed pay for all or a fair portion of subsistence costs, if they have the ability to pay. The Iowa law (Senate Bill 2398) gives the State Department of Human Services responsibility for control and custody of committed sexual predators, including evaluation and treatment costs. It includes provisions for multi-agency teams and the review of cases by prosecutors, as does

However, the precise parameters of this body of law are often unclear, perhaps due to the rapid and complex developments of our global society. In its widest context, the source of international criminal law might be derived from the general principles of international law recognized by civilized nations; and therefore, found in the customary law accepted by states, the general criminal law recognized by nations, and the treaties which govern particular conduct. International criminal law can also be categorized according to whether the conduct in question is international, constituting an offense against the world community, or whether the act is transnational, affecting the interests of more than one state. For example, international crime would encompass acts that threaten world order and security, crimes against humanity and fundamental human rights, war crimes, and genocide; whereas the transnational crime category would include drug trafficking, transborder organized criminal activity, counterfeiting, money laundering, financial crimes, terrorism, and willful damage to the environment.
