Ashar and Sandy Baker is written for people who want to protect their valuables and pass on their assets to their loved ones or to charity. It describes how to find out what your estate is worth, how to get your will to be prepared, how to have the right plan, and more. The Complete Guide to Planning Your Estate is a good book to keep around, when you think that you are ready to plan your estate and need some help to get through this complicated process.

I rated this book a four out of five star rating because this book is very useful and helpful. I enjoyed the many ask-yourself-questions in this book because they helped me think of what I should remember. I also liked the encouragements to organize everything with lists. There is very important a simple template of a "Letter to Those you love" (appendix C 297). Anyway, I wish that this book had more examples of what happened to different people and what happened if they did or didn't have an estate plan. It would have been great if in the very beginning instead of in the glossary, there was a clear definition of what an estate is ("an estate is...") for people who are not familiar with it.

I believe that after reading this book people will be fully informed about rules and regulations in estate planning for California residents. This book explains it in an understandable and clear way.

This book does a good job of explaining types of wills. The information presented is very straight forward and easy for anyone to understand.The most helpful information I found was that it clearly explained how to value your property and money.
They do a great job of explaining the different types of people that can help you plan your estate and what role each one plays. I found this very helpful to help me understand who can help me with my estate.
The only issue that I had with this book was that they focus solely on California laws. While a lot of the information in the book can be used by people from other states. The legal part is only applicable to Californians. So even though I got a lot of good information from this book I will still have to do research for my state.

Because it begins with some must knows about wills that are and are not legal in California, you may think estate planning is just about dying and wills.It is not.The authors don't just cover the disposition of your estate upon your death.They cover managing your estate while you live, so you can enjoy the fruits of your labors.

They discuss the roles of the team, (attorney, accountant, financial planner, insurance agent) that will help you accomplish that enjoyment, through the many possible milestones of your life. They cite the importance of anticipating the things most people don't want to think about such as divorce, hospitalization or impairment of a spouse or yourself.(If either of you died or became impaired today, could the other write a check or dispose of property?).They discuss alternate documents to the standard will and the ways to keep probate from eating up your estate and perhaps avoid it entirely.

Where are you currently? Why are you planning? What do you want to cover? Who are your beneficiaries? Most of the general public even in today's day and age will admit they have very little knowledge of estate planning. Every state has different guidelines and rules to follow, that can be unknown to the public, without research. California has many rules and guidelines that are unknown to the knowledge of its residents. Being from the state of Pennsylvania myself, I was ignorant to most of the rules and guidelines of the California state.
The title to this book is an understatement. Thisbook provides youthe reader, with aline by line if not word by word, very detailed explanation of each process involved with estates, Providing a vivid examples to most as well.Written in laments terms, which is very helpful to the common reader, it is a very easy read. Having a glossary with the law terminology defined for the reader is an enormously convenient help. Providing you the reading with an in depth explanation as to what an estate is, the laws that come with owning an estate, partners within, and outside partners, the ins and outs of will writing along with content suggestion, probate costs, what taxes to expect and the expenses, and much more.

This book was written prior to relevant law changes.It would have been a good reference book 10 years ago.I was looking for something more timely.

I actually worked with Alex Bove on updating a book on estate planning, when I practiced law in Boston many years ago. I purchased this book back in 1996 (the date of the current edition), but since then the laws have changed several times, most notably in February 2006, with the enactment of the Deficit Reduction Act of 2005. As a result of those changes, many of the examples and planning suggestions discussed in Bove's book no longer work. For example, all rules relating to gifting, penalty periods, look-back periods, "half-a-loaf" planning, and annuities, have been radically changed. Do not rely on the examples in the book!

That being said, his material on durable powers of attorney, trusts (other than the Convertible Trust, which no longer works), gift taxes, general eligibility requirements, and ethics of Medicaid planning, is still worth reading.

For an example of a book that incorporates all the latest changes in the law, together with case studies and numerous cutting edge planning ideas, take a look at How to Protect Your Family's Assets from Devastating Nursing Home Costs: Medicaid Secrets (3rd edition). It's pricey, but well worth it when you consider all the information and ideas packed into it!

While I own this book (I bought it ten years ago) it is now very much out-of-date. The law of Medicaid is one that is constantly in flux, changing just about every year. Recent changes to Medicaid law have made every book on the subject of Medicaid published before January 2007 obsolete. While this book and its author, Mr. Bove provided a great overview of the Medicaid planning process and for many years was the go to book to learn about Medicaid and the nursing home, today it is woefully out-of-date. For an example of an up-to-date book with information for all 50 states see: The Medicaid Handbook 2007

    I had to transact a simple probate procedure. My trust lawyer said he could do it for me and charge $2K, but that the California Probate book would step me through the necessary steps and I could do it on my own. He was right. The book is very carefully indexed and it's easy to zero in on your particular circumstance and how to resolve it. Even if your situation is complex enough to require a lawyer, this book will help you understand your situation better and possibly avoid unnecessary fees and/or being taken to the cleaners.

    I volunteered to do the probate process for my mother's estate. This book was absolutely essential. It gives clear, step-by-step instructions on each part of the probate process. However, do-it-yourself probate is not for the faint of heart. This is a major undertaking even with such an outstanding resource book. Be prepared to spend MANY, MANY hours. But, you will save buckets of money. I had the advantage of agreeable siblings and no conflicts over who got what or how much. Thank you, thank you, thank you Nolo Press.

    I found this an unpretentious and readable overview of trust and estate issues.It isn't as cute as others in the "Idiots" series, which is probably appropriate given the topic.It does make a good effort to explain terms uncommon to everyday usage to the reader and covers a lot of ground in the process.I found it odd that it didn't address the specific kind of trust that has been created for my parents, but I suspect that whenever you have an attorney craft these things, they are unique to the circumstances.

    I found this book to be practically worthless. If you take the time to thoroughly study the book it may help you understand what the attorney, that you will inevitably have to hire, is talking about. Just hire the attorney, provide the information, and let them handle the paperwork. I found that the only place I could add value was in delivering documents to the clerk of court and paying court fees.

    if this 9th edition of PLAN YOUR ESTATE was the newest edition.Clearly when boning up on estate issues one wants to know the most recent rules that govern estate planning.
    I would have liked to know there was a 10th edition, published April 2010 and I would have ordered that newest edition.
    Nonetheless, the book was as promised - clean, no pencil marks, no tears, practically new condition and for this I'm grateful.

    4-0 out of 5 stars Reviewing: "Plan Your Estate" by Attorney Denis Clifford
    It is that time of year when thoughts turn to taxes. A key part of tax planning is deciding how to manage your estate.This book, part of NOLO's "Personal Finance Essentials" is one of many books on the subject. As noted in the introduction it is aimed at five basic concepts: "leaving property, providing for young children, planning for incapacity, avoiding probate and reducing taxes."

    The first chapter looks at setting goals for your estate planning.That is done by determining what you own, who you want to give it to, how to avoid probate now that they have explained what that is, the necessity of a will, tax situations, etc. This chapter gives a brief snapshot of a variety of situations which should cover most people and the basics involved.

    Chapter two dives into situations that are difficult at best. Resolving family conflict is key and old sibling rivalries and other issues may rise again and threaten your planning. That possibility along with dealing with taking care of special needs children, multiple marriages, cohabitation, disinheriting family members and more are covered.Most of this advice seems to be generic, common sense stuff, with little detail. As a parent of special needs children, I was very disappointed in the very brief discussion on the topic and found it nearly worthless despite the reference to one point later in the book.

    Chapter three covers the rules for property ownership for married couples. Texas is a community property state, as noted in the chapter, and as such that means that both my wife and I share ownership in something even if only one name is on the title or deed. We also incur the debt load equally and the income as long as we are living together. The authors go into great detail by definitions and example illustrating what is community property and what is separate property. They also illustrate rules for different states and how moving from one state to another can and will change things.

    Chapter four covers how to inventory what have you have. You need to figure out what you own, what you owe, and what your net worth is. This is a fairly straight forward deal that you should be doing anyway as you work on your taxes. The authors make the point to count everything (including frequent flyer miles), to plan for your cyber accounts and groups, and keep good records.To that last point, a number of mostly blank form pages are included so that you can list your property and determine net worth.

    "Your Beneficiaries" is the theme of chapter five. Over eleven pages, this chapter covers the types of beneficiaries, what you can do with them, and various possibilities and outcomes including disinheritance and no-contest clauses.

    Chapter six returns again to the topic of children and setting things up for them. Whether you want your spouse to be in charge, a trust, want to make educational investments for college, etc are all covered along with numerous other situations. Like most of the chapters in this book, this complicated subject is skimmed lightly to give the reader a working knowledge basis to build from but not much more than the absolute basics.

    Wills come next and the many types are defined, explained as are their limitations. Chapter seven also covers whether or not you need an explanatory letter with your will and how to best write one. What happens to your will upon a divorce is also briefly covered.

    Chapter eight covers probate and how to avoid it. In most cases, one does want to avoid probate but the authors also consider when probate would be best.At eight pages of information, this is one of the shortest chapters in the book.

    Living trusts and all their many varieties and ramifications are considered in chapter nine. After you create one, you must keep it up to date and this chapter address that part of the issue as well.

    Chapter ten considers the idea of joint tenancy and its many complications. Simplifying greatly, this is when co-own something and do so to avoid probate later. Primarily this is housing and or land. Over eighteen pages, the authors consider the subject and explain how it works, positives and negatives, and how it can affect your estate planning.

    Maybe you want to set up something that will pay certain accounts upon death. That concept is covered in chapter eleven along with how to set up transfer-on-death deeds for real estate.

    Chapter twelve covers the concept of "life insurance" and all its many types, rules, taxes, etc.

    Retirement benefits such as 401 k's, Roth IRA's etc get the same brief overview in chapter thirteen.

    There are state law exemptions to probate and those are covered in chapter fourteen. California, New York, Florida and my state of Texas, are highlighted with very brief explanations.

    Chapter fifteen covers the thorny issue of estate taxes. Will the estate owe taxes, how to calculate them, how to redeem them, etc are all covered both from a federal and state level.

    Chapter sixteen covers the same issue; from a "gift" angle. It defines what a gift is, how to value a gift, how to use gifts to reduce estate taxes, etc.

    Trusts are covered in the next several chapters with chapter seventeen giving "An Overview of Ongoing Trusts."As noted, this chapter is an overview and explains what they are and how they work. Chapter eighteen covers the subject of "Bypass Trusts" and how they can help reduce the tax bill. Chapter nineteen looks at other tax saving trusts for married people and primarily considers to "Qualified Terminable Interest Property" trust also known as QTIP. Chapter twenty delves into the various charitable trusts and how they work. Chapter twenty-one continues the trust angle with numerous other types of trusts such as "Grantor-Retained Annuity Trusts, Grantor-Retained Income trusts" and many more.

    Chapter twenty-two explains how one can disclaim property that has been assigned to you through inheritance. Like everything else, there are rules and procedures as well as reason to do this.

    Chapter twenty-three returns to the idea of trusts and explains how to combine them. Chapter twenty-four considers trusts for the second or more marriage. More controls for property are considered in chapter twenty-five.

    Incapacity and how to have things setup to make medical and financial decisions is the theme of twenty-six. That naturally leads into death, body and organ donations, funerals and all the rest of it in chapter twenty-seven.

    Do you have a family business?That finally gets covered in chapter twenty-eight and how to deal with it. That naturally leads into the need of lawyers which is covered in twenty-nine.

    So finally you have your estate plan.What to do next is the theme of chapter thirty regarding all of the many things you have created.

    Then, after all the planning is done, everything is set up and now comes crunch time. The death has happened. Chapter thirty-one addresses what has happened and how to follow through on all that planning.

    Chapter thirty-two considers eight widely different scenarios of people needing estate planning and how they should set up things based on their particular situations.

    An eleven page glossary of terms, various appendices on tax rules, a twenty five page index, and a couple of ads for other NOLO products and services bring this 552 page book to a close.

    Released last April this informative book meets the five goals set out in the introduction. Straight forward and simple to read, it gives the reader a basic working knowledge of the subject matter and serves as a good reference point or resource guide. Like any book on the subject, the information in it is subject to change and depending on the complexity of your situation it might be best to consult with a professional. Still, for the market and knowledge base this book is aimed for, it does the job well and is a very good source of info.

    If you are like most Americans and do not expect to have a multi-million dollar estate when you die, then this isn't the book for you.Just max out your IRA and 401(k), and read a book about living trusts.(However, you might still be interested to learn how many ways the super-rich can circumvent estate taxes by legal artifice.)

    If you do have a substantial estate, then this book is a great place to start.If nothing else, it tells you whether or not you need a lawyer.Even if you do, I would still recommend reading this book cover-to-cover, so that you fully understand your estate plan and are aware of the alternatives, as well as of the implications of tax law changes.

    It's a shame that laymen have to waste their brainpower worrying about such unnecessary complexity as financial estate planning, but so long as the majority suffer from the delusion that this is an effective means of taxation, we're stuck with it.This book will guide you through the complexity. ...     4-0 out of 5 stars A nice book on estate planning that made me feel like I was reading an online blog.

    This book was better than most I've read on estate planning. Its objective was to familiarize the reader with the estate planning process. I'm not sure it really covered "the process." But I think it educates the reader well enough to be an educated consumer when consulting an estate planning attorney for help in estate tax planning matters.

    As I read I got the feeling the authors were anti-probate and pro- living trusts. And there were certain things included in the book that made it sound like a promotional piece for the authors' own law practices and organizations. I would have liked it better if the book had not come across as a promotional piece.

    The authors say to treat this book as a survey of what estate planning can be. When reading this book (7 years after it was written) I got the feeling the content could have been a bunch of blog entries the authors have posted online that they conveniently strung together to make a book. There are 42 chapters and 4 "entries" in the appendix. And the book is only 330 pages long.

    I was looking for a Glossary of Terms, but failed to find one. The book would have been better with one. And I would have liked the book better if Appendix D about the history of estate planning had been moved to the front.

    Chapter 1: What is estate planning? I felt this chapter was lousy. It was wordy and vague and not really accurate. Estate planning is really "estate tax planning." It is not financial planning or "wealth strategies planning" as the authors suggest. Nor is estate planning to be confused with "disability planning." As a result, I'm not sure why Chapter 4 was included.

    Chapter 8: Probate. I enjoyed reading about estate administration in this chapter. But I think the authors did the reader a disservice by equating the probate process to estate administration. Other problems I had with this chapter include the statement made that executors work for the probate court or probate judge. This simply is not true! Executors work for the estate (a separate legal entity). And the statement that probate is complicated is not accurate as stated. In some cases it can be. But in most it is NOT.

    Chapter 9: The federal estate tax. Here the authors repeatedly referred to the estate tax as a death tax. The estate tax has nothing to do with death. It only has to do with wealth transfers. If a poor person dies, then no estate tax is due. If the estate tax were really a death tax, then a tax would be due when a poor person dies.

    Chapter 10: The unified system. I had a problem with the material the authors chose to talk about here. Why was it necessary to discuss the way things used to be? As far as I am concerned the book would have been much better if the authors had stuck to the present and explained how things are now. The presentation of the material would have been much more straighforward and easy to understand. 4 stars!

    I bought the previous edition of this book several years ago and learned so much from its straight forward, well-organized and clear presentation (I am neither an accountant nor a tax person) that co-workers and family members began quizzing me on matters of estate planning.This book allowed me to answer many questions and also enabled me to have a very intelligent conversation with a professional estate planner. I consider the book such a valuable resource that I just purchased the updated edition.

    If you have kids, this book is a "Must read".If you & your spouse should suddenly die what would happen to your kids?If you don't have a Will, they could wind up with your least favorite relatives.

    My husband & I put off doing our wills because it felt morbid to me.After talking with friends & a lawyer,I now know it's not about me, it's about planning for my kids.As I'd planned forother aspects of their young lives - schooling, meals, activities, outings, etc.

    It was a gruelling process for us 35 yrs ago, talking with lawyers - trying to understand legalllize.

    Lisa Hanks writes "...basic estate planning isn't legally complicated, it's emotionally difficult" and this is why most people put it off until it is too late.

    I hoped I was not the only person who misread the book's title and assumed it is only for single mothers. I soon learned I wasn't as Hanks addresses the book's title in her introduction:

    "It's not that dads aren't interested or involved--far from it. They are active and essential participants. It's just that mom usually gets the ball rolling. And trust me, you've got the skills required to make sure this project gets finished, too. Anyone who can juggle a family for one week--logistics, finances, health care, emotional havoc--can put an estate plan together."

    The Mom's Guide to Wills & Estate Planning is a well-written guide that covers estate planning for parents. It covers wills, living trusts, retirement accounts and life insurance. The book also provides a series of estate planning worksheets that include a will worksheet, an inheritance planner and a family inventory. Credit the easy-to-understand format to Nolo's practical writing.

    I'm familiar with Nolo reference books (I think this is the sixth Nolo book I've reviewed for Amazon) and find most to be a great starting point for learning the basics of a new topic.

    This book is smaller than in size and length than most Nolo books. The advantage is the book is easier to carry but the font size is a bit to small in the worksheets. The USA Today snapshots spread throughout the book are little more than window dressing though and do nothing more than break up the text. That is a minor complaint, considering the amount of helpful information included in this guide.

    One last caveat: you should not substitute the book for face-to-face legal advice. This guide covers the estate planning basics you need to protect your family. Read it and use it as intended but don't forget the author is an attorney herself, so don't hesitate to contact your own for help.

    This book was exactly what I needed. I am starting from nothing and need to plan for the guardianship and financial care of my children should something happen to me [I am a single mother with an absent ex spouse].

    This book walks you through every step you need to consider when creating a will & planning your estate. She covered things that I had never even heard of [and I'm not an idiot -I'm a well educated person].She starts from the beginning and covers every aspect, including the more esoteric things only more wealthy people will need to consider.

    The author asks questions and gives instructions that make it easy to formulate a plan. Guardianship of my children is something I worry about constantly - and the author gave a very detailed set of instructions on how to determine who should be guardian of the children if I die and how to handle it. I found her friendly, non-nonsense approach very helpful in tackling this difficult issue.

    One of the things I really liked about this book was that it is aimed at a very broad audience - she has sections to help single mothers, to help same sex couples, to help remarried people with children from previous relationships, etc. I was surprised at how much she included for "non-traditional" families and I really appreciated that.

    If you have a child in your care, this book will give you the complete, step by step information you need to provide for them if the worst happens.

    The book is also well written and very easy to read - it does not get bogged down in legalese or anything like that [which would be easy to do with this topic].The author is an excellent writer and comes across as a very friendly, compassionate friend giving the reader good legal advice.

    I was surprised by how very complete and helpful this book was and I am grateful I read it.

    I wish I had had this book years ago.I no longer have young children, and I have already had to help my mom plan her estate.It took some trial-and-error with planning my own estate and with helping my mom.If I had had this book, things would have been easier, and we could have had a check-list to make sure things got completed. The book is written in a simple and straight-forward manner, and provides the information necessary for estate planning.While it is called "mom's guide," it could be used by anyone to help plan for their family's future.This is a useful addition to any family's library, and could really help them avoid stress and problems in their future by enabling them to plan ahead for the inevitable.

    Seriously, she is.She picked up this book when I was about halfway through it to look at the table of contents and said, "Wow, that's a great presentation and series of topics."

    Having read the book, I can confirm that there is substance presented in a understandable way beyond the table of contents.

    If you have $3.5M or more in your estate, hire someone.Regardless, this book is a good read, and something that we parents should give more thought. ... Read more
