Jurors found Pethis guilty of organized criminal activity. The punishment phase of the trial continues Thursday. Visiting Judge Billy John Edwards overruled the motion in limiting in a pre-trial hearing Wednesday. James Masonheimer says he shot Gilbert Sanchez because he threatened his daughter. This motion prevented the defense from going into any bad acts committed by the victim. Judge Edwards also requested all evidence be shared. In the last trial, the defense accused the prosecution of withholding a witness' statement. That trial ended in a mistrial. Masonheimer's new trial will begin April 21st in 104th District Court.
