Extractions: Criminal procedure is composed of the rules governing the series of proceedings through which the substantive criminal law is enforced. In the United States, most crimes are defined by local and state government, though the federal government has adopted its own criminal code, at Title 18 , to deal with activities extending beyond state boundaries or having special impact on federal operations. The procedure for criminal trials in federal courts is outlined in Title 18 . States also have statutes that set out the framework for criminal procedure, subject to important constitutional limits. For example, the U.S. Constitution Bill of Rights provides basic protections including the right to an attorney, the right to not testify, the right to confront witnesses, and the right to a jury trial, among others. State constitutions may increase, but not take away from the federal protections. The American criminal system is an adversarial and accusatorial model. Criminal procedure must balance the defendant's rights and the state's interests in a speedy and efficient trial with the desire for justice. Therefore, the rules of criminal procedure are designed to ensure that a defendant's rights are protected.

Few people believe our Courts are working well. All have come under scrutiny in recent times. The Environment Court's backlog of 3000 cases highlights the problem. The appointment of a new Environment Court Judge will help. But while that backlog is being dealt with more and more new cases are being filed. Both the economic and emotional cost to litigants continues to rise exponentially. There are many reasons why our Courts are clogged up. First, politicians love to pass new legislation. In the last Parliament (1996 - 1999) 371 Acts were passed. It doesn't matter which Government is in power our lawmakers press on regardless - often heedless, of the impact that legislation will have on the Court's ability to cope with it. The Resource Management Act is but one example. About 1900 Resource Consent applications will take about a year to be heard by Councils. It will then take a further 12-24 months to hear the 800 appeal cases.

They drain out of the system the inefficient and allow for the reallocation of capital and labor to the most efficient enterprises. When recessions do occur, the safety of investments and the speed of recovery will partly depend on how quickly the reallocation process takes place. The assessment of the potential risk for any investment or loan will depend on the same process. One aspect of this process, the bankruptcy system, has until recently received little attention in Asia. The remarkable success of the area has led many to ignore the consequences of potential failure. Like ports, roads, electricity and education, efficient and honest legal structure is an integral part of a country's infrastructure. The quality and procedure of the insolvency system vary widely between Asian jurisdictions. The competence of each system seems to have been generally ignored in quantifying a country's risk premium. As various countries recover, these distinctions should become more obvious. One generalization can be said for the entire area. With the unusually long expansion the judicial, legal and often cultural resources are simply not available. Even if the laws in place were consistent with the most recent and enlightened legal and economic thought, the personnel to administer the system is simply not available. This bottle neck will have a profound impact on the length of the recovery across the region. Growth will return, but legal systems are perhaps the most difficult parts of an infrastructure to construct.
