Judge Louis Arbour suggested Quebec's welfare regime put young people's long-term health and lives at risk: "The right to a minimum level of social assistance is intimately intertwined with considerations of one's basic health and, at the limit, even one's survival." Judge Bastarache suggested that the huge gap between the number of youth reduced to living on welfare-more than 80,000-and the restricted number of places in the government workfare schemes-30,000-indicated that the government's primary interests was in saving money, not the youth's betterment. In a ruling issued December 19, Canada's highest court rejected a Quebec woman's claim that her constitutional rights had been violated during the late 1980s when she was forced to subsist on a welfare stipend of between $163 and $170 per month. Louise Gosselin's class action suit claimed that the Quebec government had violated the guarantees in Canada's Charter of Rights and Freedom to "life, liberty and security of the person" and against discrimination when it provided single youth with a monthly welfare stipend that left them without life's bare necessities and which was far below the $448 a month paid persons aged 30 or more.

The Queen et al was heard. Oral submissions were made by counsel for Vriend, counsel for The Queen and numerous intervenors arguing in support of one of the other party. The hearing ran from 9:45 a.m. until 4:45 p.m. with a short break for lunch. As you can imagine it is not possible to do justice to all of the submissions made. There were so many good arguments put forward. I will attempt to give you a taste of what kinds of arguments were made. The arguments put forward by Vriend's counsel, Sheila Greckol (and I am doing her a disservice by scrunching the submissions which were made so eloquently over the course of an hour) were briefly as follows: - discrimination against lesbians and gay men exists in Alberta society. The former auto mechanic from Alberta also thanked the Canadian public and news media for focusing attention on his case. "He wasn't dancing or anything like that, but he was obviously very happy," said Larry Fitzgerald, a spokesman for the Texas Department of Criminal Justice. Earlier in the day, the 5th U.S. Circuit Court of Appeals in New Orleans had lifted a stay of execution granted Wednesday by U.S. District Judge Sam Sparks, who questioned whether Faulder got a fair hearing from the Texas Board of Pardons and Paroles before it turned down his bid for clemency. Texas officials then began preparing to put Faulder to death. But his attorneys appealed to the Supreme Court, which granted a stay "pending disposition of his petition," according to a court spokesman.

"We are delighted that the court has recognized the importance of confidentiality of patients' clinical records," says Dr. Philip Beck, chair of the CPA's Professional Standards and Practice Standing Committee who worked on the CPA's third-party intervention in the case. "The CPA stressed there should be adequate safeguards for disclosure of patients records and this decision took that into account." Dr. Graham Clancy, of the Canadian Academy of Psychiatry and the Law who also collaborated on the CPA's intervention, says, "The privacy interests of our patients have been recognized, but that right has been balanced by allowing the judge to rule that disclosure may be "necessary in the interests of justice." CPA chair Dr. Pierre Beauséjour adds, "We are delighted the decision recognizes clinical records for what they are and supports having someone neutral (the judge) make the decision about whether the records should be accessed in each case."

Today’s decision removes any uncertainty for those who have been awaiting a decision before applying for a licence," said Anne McLellan, Minister of Justice and Attorney General of Canada. As of January 1, 2001, Canadians will need a licence or a valid Firearms Acquisition Certificate to own or use firearms or to acquire ammunition. A series of initiatives is now in place to assist firearms owners in obtaining a licence before the end of the year. New measures include: a simplified, one-page licence application form. the fee for the possession-only licence has been reduced from $45 to $10 for those who apply by October 15, when it will rise to $60. Those who have paid the higher fee will receive a refund. responding to requests from the firearms community, the $25 fee charged for the transfer of firearms is being waived until the end of this year.

JEBCO SEISMIC 2003 OK 35 ¶0 Plaintiffs brought this action against Jebco Seismic and Jebco Seismic L.P. in the District Court, Beckham County, Doug Haught, trial judge, to recover monetary damages for injury to real property. Defendants filed a third-party petition against PGS Onshore, Inc., alleging that the third-party defendant was liable for any damages suffered by plaintiffs. Defendants and the third-party defendant admitted liability prior to trial and the issue of damages alone was tried to a jury. The jury returned a verdict for plaintiffs in the amount of $26,000.00. Plaintiffs then moved to recover their attorney's fee and costs. The trial court granted a fee in the amount of $17,005.00. Defendants appealed from that order.
