Burns The Age Discrimination in Employment Act (ADEA) prohibits discrimination in the workplace on the basis of age. To establish a prima facie case of age discrimination, a claimant must demonstrate that he/she 1) is in the protected class of age 40 or older; 2) was performing to the employerbs legitimate expectations; 3) was subject to an adverse employment action; and 4) that similarly situated and substantially younger employees were treated more favorably. Also, the ADEA proscribes discrimination against job applicants on the basis of age. The ADEA is a separate law apart from Title VII of the Civil Rights Act of 1964, which is the basic federal law which covers most forms of discrimination in employment. Discrimination based upon age was not a part of the 1964 law, but was enacted as a separate statute by Congress in 1967. This legislation is unique among this countrybs anti-discrimination laws in that it establishes a "protected classification", i.e., those age 40 and older, which all of us, if we are lucky, will one day attain.

HISTORY In January 1988, a meeting was held to discuss the powerful consequences of an emerging epidemic called AIDS. That day, 140 countries attending the World Summit of Ministers of Health on Programmes for AIDS Prevention unanimously agreed to support one internationally recognized campaign to combat HIV/AIDS. Now observed annually on December 1, the first World AIDS Day theme was "A World United Against AIDS." As early as 1989, ACEI recognized the importance of education in the prevention of AIDS. In the spring issue of Childhood Education , the organization published M. Patricia Fetter's article "AIDS Education: Every Teacher's Responsibility." The prelingually deaf are a distinct group of individuals who have been profoundly deaf since birth or early childhood and who communicate using Sign Language. Unlike those who have gone deaf in later life they have generally never heard the spoken word. English is their second language. They have a unique culture of their own. When writing the word deaf they use a capital D to signify that they identify themselves as part of the Deaf culture. Different Lives What is the current mental health provision for Deaf people? There are three Deaf services in the UK (London, Birmingham and Manchester). These are mainly aimed at the adults of working age population. All services will see people over the age of 65 years. Referrals for this group are low in number, experience is never really built up and the medical and psychosocial interventions used in old age psychiatry forgotten. Conversely, the local Old Age Psychiatrist may not have the knowledge and experience of Deaf culture or Sign Language. Many do not get referred at all. We know from research in the Deaf general adult population that this lack of familiarity can lead to misdiagnoses and mismanagement.

Yet graduate school in a life science requires such time-consuming and intense research efforts that life can include little else. This can create difficulties for students over age 30, who are more likely than their younger counterparts to have families. FAMILY TIES: Elizabeth Luna, who has mentored older Ph.D. students, notes that having children creates extra demands on one's time. Older graduate students say that while experience in life and the workplace brings certain advantages to handling graduate school, responsibilities can intervene. "Different family circumstances can cause additional demands on graduate students. Most graduate students, for instance, don't have to schlep kids to soccer practice," observes Elizabeth J. Luna, 45, a senior scientist at the Worcester Foundation for Biomedical Research in Shrewsbury, Mass., who has mentored several older Ph.D. students. But experience in the real world can give older graduate students an edge. "Students who came in for a Ph.D. right out of their B.S. degrees were not psychologically as well prepared to deal with the stresses. They had the smarts, but they hadn't been in [a work] environment where everything you do is criticized," says Dirk Vanderklein, a professor of biology at Montclair State University in Montclair, N.J., recalling his graduate school days. Vanderklein attended grad school when he was in his early 30s.
