The Missouri Court of Appeals' Eastern District said comic book creator Todd McFarlane was free to use Twist's name in his work of fiction partly because the only resemblance between the player and the character was a reputation for violence. "We conclude that a reader could not reasonably believe that the Twist comic book character is meant to portray, in actual fact, Twist the hockey player," the three-judge panel said in an opinion written by Judge James R. Dowd. Tuesday's ruling upheld a St. Louis circuit judge's November 2000 dismissal of a $24.5 million jury award for Twist. Twist said McFarlane violated his rights by using his name without authorization. He also argued that McFarlane cost him endorsements and other business by associating his name with a character who is a brutal Mafia killer.

Our hotel had CNN, but it was CNN World, which means that it focused on the rest of the world. I now know more than a person should about the Euro 2000 Soccer tournament (more on that later), Wimbledon tennis (ditto), and auto racing. I could only get the baseball scores once per day and had no idea that the White Sox had opened up a 10 game lead over the Indians. It makes one want to go out and watch some baseball. The Value Of The Euro Is Falling Anyway, France won the tournament and it seemed like they were very lucky. They won in overtime, on questionable calls, etc. Unlike the World Cup, however, the games were not being played in France, so there was no home country bias. Still, they were very lucky to win; trailing 1-0 to Italy in the final game until 3 minutes were left, when France scored. In overtime, the French won the European championship. My only regret was that we left the country as the final game was being played. I can only imagine what the party would have been like after the French win. On The Grass The men seem to be heading toward Agassi versus Sampras, again. Agassi has played well enough to reach the semifinals despite not being particularly overwhelming. He had to serve his way out of trouble in the quarterfinals and will now face Patrick Rafter. Sampras reportedly has tendonitis of his ankle, but he has been making his way through the draw anyway.

Twist hits the NHL 2Night set at 11:30 p.m. ET Tuesday. Twist spent 10 years in the NHL with the Quebec Nordiques and the St. Louis Blues. He was the ninth pick by the St. Louis Blues (177th overall) in the 1988 entry draft. He played in St. Louis and with their farm team in Peoria, IL until being traded to the Quebec Nordiques in 1991. Tony played with Quebec until he was reacquired by the Blues as a free agent in August of 1994. He collected 10 goals, 18 assists and 1121 penalty minutes during his career. In his free time, Twist rides his Harley Davidson across country as part of "Twister's Iron Horse Tour" to collect money for charity. This summer's edition will see Twist ride from Los Angeles to Denver starting July 15.

The ruling came in Twists lawsuit prompted by Todd McFarlanes creation of a character named "Twist" in the comic book "Spawn" and an animated series on HBO. In Spawn, "Twist," also known as "Antonio Twistelli," is a vile, vulgar mobster who was also known as Don Dracula. Twist, who has been out of the game since last June and is recovering from injuries suffered in a motorcycle wreck last August, testified that the character reduces his opportunities to endorse products and harms his aspirations for a post-hockey career of public speaking and sports broadcasting. Sports fans may remember McFarlane as the man who paid over $3 million for the baseball mark McGwire hit for his record 70th home run two years ago. In a published response to a fans letter, McFarlane had acknowledged that the "Twist" character was named after a player on the Quebec Nordiques, Tony Twists former team. According to the St. Louis Post-Dispatch, when asked by Twists lawyer at trial if he knew of Twist when he named the character, McFarlane stated that "he may have come across it in the sports pages." McFarlane testified that had he wanted to give a character name recognition, he would have picked a name other than Tony Twists. McFarlane told a St. Louis Circuit Court jury he would have come up with something such as "Wayneatelli Gretzkytello." McFarlane did acknowledge that he attaches the names of friends and others to his characters but insisted that he never bases his characters personas on real people.
